# car deposit... refundable?

sry about the vortex statement, lol, figured that it would mean something to a dealership who sells vws, guess i was wrong
fry my numbers are this
when i went to schmidt’s i was going to put 10k down, finance through vw and receive 2.9% financing, was going to do it for a span of 48 months, and have a payment around 250
i found this dealer and they were giving me a car price that was $1400 cheaper then schmidt’s, they originally led me to believe i could do 10k down and span for however long i wanted, then they told me that i must finance 15k so i could only put 5k down, so then they suggested to me was doing it for 60 months to keep a low payment, but just putting another 5k down after so it would go towards the principle and shorten my term
so thats what i agreed on, assuming i could get the 2.9% financing through vw, then they told me they finance through another company and that i would have to finance that way or else they would charge an additional $650 onto the cost of the car.
then i got the rates back and they gave me a 4.8% on it
ill call vw in a few and see what is said

call the dealer and get the price of the vehicle in writing. Then call penfed and get them to cut you a check for that amount minus whatever you want to pay in cash at a 2.49 interest rate. Hand the dealer your cash and the bank draft. Problem solved.

their stipulation was you must finance through us for a minimum of 3 months, I’ve been considering just doing the deal with them then after 3 months doing something like this
if i told them i wanted to pay in cash they would add an additional 650 onto the price of the car

I didn’t see it mentioned, but has anyone looked up the law on this subject in RI? I know it was posted for NY and PA.

This is what they tell you. Sometimes it’s true, but sometimes they get you a better rate than initially thought and keep it at the higher rate to make that money for themselves. Or sometime they just come back with “gee, your credit isn’t as good as we thought so your rate is 1% higher” and take that 1% for themselves.
This is especially suspect when a dealership tells you your only finance option is to use their lender.

Mike please dont tell me this is over some fuckin turbo diesel rabbit…? LOL but yea dealerships are shady as fuck. If im reading correctly u pretty much just gave them money " under the table" over the phone with no proof of it ever happining? It seems like its gonna be tough to get it back but GL man. Just tell them you will call the BBB. Usually buisness’s dont like to hear that.

BBB doesn’t mean anything. Business’s LOVE hearing this because they know you have nothing else to come at them with.

I don’t think its necessarily true, I’ve used the BBB to recover over grand in the last couple of years, who wants any type of blemish on their record?

The NYS law covers this transaction because although the dealer is located in RI, it is doing business in another state.
So them doing business in NY puts NYS law in effect for this. ( As long as they are advertising in NY and/or have done business in NY before.) If you had signed something it could be under a different statute.
Unless you found out about the car and the dealership through online advertising, that makes things even more tricky.
All in all the only thing that law can do is help you either in court or threaten them with that but without a lawyer it might not have any effect.

Maybe they love to hear this, may they don’t. It is still one more step in the process so that you can show the judge you gave the business ample time and opportunity to do the right thing.
