My insurance company is now saying I have no claim against the Town unless someone else complained about the problem before me and they never fixed it. ---

Yeah, I believe in NY if you report damage they have like 48 or 72 hours or something to fix the pothole/road damage before you even have a chance at submitting a claim. Something stupid like that. ---

I swear there was a thread all about how to file these claims but I’ll be damned if I can find it with the crappy vbulletin search. But yeah, I remember reading that for the town/county/state to be responsible the road hazard has to have been reported prior to it causing damage. It sucks, but at the same time makes sense because it’s pretty unreasonable to expect the state to be constantly inspecting every mile of every road. They become negligent, and there by responsible, once they know of a hazard and do nothing to address it within a reasonable time frame. ---
