theres nothing in the penal law about accesory…

theres a couple charges for facilitation but you have to do something knowing the person youre helping is going to commit a crime. Selling a rifle to a person of poor moral character that you aren’t sure would pass at a store backround isn’t faciliatation. It doesn’t meet criteria for criminal liability. I’m sure there are charges for selling to someone who you know is a felon though I don’t know what they are.

prolly just criminal purchase.

I’d rather cover my ass than to sell to someone who doesn’t seem legit. We are in NY, remember. Not exactly pro-gun.

For selling to someone you know for sure is prohibited from possessing a firearm it goes against 1 8 USC § 922(d). It’s punishable by up to 10 years in prison.

So if that person is a: felon; drug user or addict; aliens who do not possess a green card or not admitted for permanent residence; subject to a restraining order; prior convictions for domestic assault; fugitive from justice; or dishonorably discharged from the military.

Drive to Virginia, buy guns for pennies on the dollar at a gun show, drive home. Yay!

> 1. To buy online from a dealer, no matter their location ([Budsgunshop.com](http://Budsgunshop.com) is the cheapest I’m aware of), you simply buy it like you would anything else. Throughout the checkout process, it’ll have you select a local dealer (FFL-Federal Firearms License) that they will ship it to. This needs to be done because the local dealer will be doing your background check before you can leave their shop with the gun. Fees vary by dealer. Big dealers that have storefronts will charge easily $50 for the transfer. A guy running out of his house will do it for $15-25. That’s the route I go, as I’ve developed a good rapport with a couple guys in the area who sell out of their house. It’d be best to call the local dealer ahead of time to let them know you got a gun coming in, and your name, and the make/model of the gun.

> 3. To buy online from a private person (not a dealer) who is located in New York State, they can ship directly to your house, no dealer needed.

> 4. To buy in person from a private person (not a dealer) who is located out of state is against the law (felony), as per BATFE.
