The guy is being a douche. Didn’t comply with a lawful order from a law enforcement officer, that is pc enough to pull him over and detain him. ---

This has been going on long before the patriot act. You guys should get out of WNY once and a while. Try cruising Rt 37 between Alex Bay and Massena, NY. They have random Border Patrol checkpoints setup there all the time, and were doing it back in 1995 when I first started driving to Buffalo. I can remember seeing them even before I had my license. They do it because good smugglers are smart enough to sneak around the custom’s station, but often let their guard down once they’re here and just cruising down some state road. ---

Like he said this is very common down there. I was north of San Diego and they had these set up. Now that I think of it I was driving form the Grand Canyon to La last November and ran in to one of these in NM. On one hand it amazes me that the immigration/smuggling problem is so bad they catch people on major thoroughfares in broad day light. On the other the guy is correct in standing up for his and our rights. I have never said no to an “unreasonable search” because it would put me out too much and I had noting to hide. If it tied up traffic blame the authorities for not having the proper facilities for the operation ---

I’m actually surprised at how much the BP agents kept their cool. Now if that was a NYS Trooper, he’d be in a jail cell right now and they would be illegally searching his car. ---

This guy is a fuckin retard in the video anyways. which was why he wouldnt open his window, which is why he had the camera, which is why he cut off the officer everytime he spoke. and would not answer any questions He would not show his license, i think i would have pulled him out of the car there. ---

Any time an officer has to ask you whether he can search you or your property, it means that he cannot legally search you without your consent. Refusal to allow a search and insistence on your constitutional rights _does not_ give rise to probable cause, which would allow the police to search you or obtain a warrant. However, the way in which you refuse a search request could give rise to probable cause. ---

IT DOES, if you’re not being a complete retard they won’t do it, but they can if they really wanted to. When i get pulled over, they ask if i have drugs etc etc, i tell them no, if they really wanted to, they could search my car anyways, but it wont happen because im not a stupid fuck if they asked me if i had drugs and i said "Well you cant search my car because it’s my property not yours, guess what, they’re searching your car, because they already had legal power, and now they have even more reason to 🙂 ---
