I think your fine to be honest. In NYS, you have every right to defend yourself by any means necessary if you are attacked. You could have let him hit you and then attempted to call the police and he would be charged with assailt. However who knows what he would have used to keep you down, so its good you were able to get away.

If you don’t know what thermite does…
Once it’s lit it can’t be put out with anything the fire company would bring. Not that it would matter because long before the fire company would show up the car would be toast.

ya thats the thing. im between two cars at 1am when he is already hostile, it doesnt matter if he was 18 or 80. anyone can do damage with a knife, bottle, wrench, gun, etc.
hopefully the DA sees it that way and sees how outrageous his report was and that I was the first call to 911 after it happened.

I had a similar issue where I had a fight out of self defense, parents pressed charges, got a lawyer and got it dismissed, but mine went on to court for about 10 times and a 3k lawyer bill…

Def a good read. I know it is just your side of the story, but it seems that you were justified and did not act recklessly or with intent so I wouldn’t be too worried. I also think that you really saved yourself by bringing the lawyer down with you and its good to see that you can get some good advice on nyspeed every once in a while lol.

This is the erie county da’s office. They are complete Tools and totally untrust worthy. Dont speak to them without your lawyer present. Seriously!!! They are the worst of the worst for twisting situations all over. If their investigator Jack comes to talk to you tell him to get a fucking supeona. Honestly dont say a word to any of them.
Those assholes can suck my dick. Most motherfuckin Unprofessional assholes out there.

Ya anyone who comes to talk to me or ask me about it from the police or any office I just am telling them I would like my attorney present. I have never been in this situation before so that is usually my excuse so I don’t come across as uncooporative since I am not at fault.

This is a video by 2 lawyers, one is even a fromer cop, they clearly explain why you NEVER NEVER NEVER talk to police. Let them do all the work, shut your mouth, and let a lawyer do all the work. Please, this is an eye opener. Even if your innocent, your words can get you in alot of trouble.

Ya when the cops showed up after the 911 call, they knew the family, the knew where him and his wife used to live, and the detective that took my statement said he has arrested their son in the past.

When we toured the apartment, the landlord did say that there was issues with the lady below us (his wife) and that people have had trouble dealing with her.

This is why I have a lawyer and took the advice off of people on here. Everyone was right. The detective tried to get me to stumble over my words and def made is seem like I was guilty already. My lawyer cut him off and reexplained stuff to him which was really helpful. Its my first time in this situation dealing with police and the court system so def rather have someone who has been doing this for years and knows the system helping me and dealing with the police.

Ya he said that he used to be a DA and knows the way its working. He was an older guy and said he had 18 stitches and obviously had a different story then me. He said that their basis is going to be that his injuries are inconsistent with my story. Hopefully it just works out. Probably will go to trial becuase I am not pleading guilty to striking him when he came after me.
