# Quit-Claim Deed?

Well I don’t know if anyone can help.  
Here is what I want to do, I currently am on a mortgage and deed with my father. He basically gave the house over to me about 4 months ago. I found out about 1 month ago he is filing for chapter 5 bankrupcy.  
I’m currently in the process of refinancing with my fiance as I want to take over the house.  
Here is the question:  
I want to take him off the deed and mortgage. I want t take him off the deed then when I refinance then I don’t have to worry about that.  
Can I go to the Erie County Clerk Office and ask for the quick-claim deed form and fill it out?  
Do I need a Attoney?  
How much is the form and the fees to do this?  
How long does it take?  
any information will help.

fyi it’s quitclaim, you can get them at places that print legal form for $1, or find one online and print it out. All I know about them.
