# Shotgun Purchasing Q's

Where’s the best place to get one?
As long as it doesn’t have a foldable stock it’s legal in NYS right?

No registration. No Fees, and the only tax you pay is sales tax (for now at least). When I bought mine 10 or so years ago, they had to hold it for a couple days to do some sort of background check… I think that still stands.
Can’t have a sawed barrel or a pistol grip either.

You should be able to walk in and walk out with a shotgun in about 20 min in NYS.
As for folding stock you should be OK as long as you’re not buying a Saiga or something.

Yes, you can.
Anything you see in the store, you can buy. Pistol-grip shotguns are perfectly legal. Read the statute you posted.

Pretty sure they are legal in NYS. They have a few pistol grip shotties at the Buffalo Gun Center. Most of the pistol grip ones are 16 or 20 gauge for recoil and control issues

You live in NYC right? Look into the city laws where you live. I know the differ from NYC compared to say Long Island or other parts of NY.

Yeah you’re right, can’t have a pistol grip and something else like extra capacity. Then it’s illegal.

The “assualt weapons” ban only applies to semi automatic long guns. so get a pump action shotty and you don’t have to worry about pistol grips or folding stocks ect…

* Folding or telescoping stock
* Pistol grip
* Fixed capacity of more than 5 rounds
* Detachable magazine
```

Pump-action, tube-fed shotguns are fair game.

If going with a pump I’d recommend the Remington 870 over the Mossberg 500. The 870 is a much nicer gun for roughly the same money.

I like smallish looking guns. I’m looking at the 870 with the 14" barrel lol, is that even legal for a non-law enforcement guy to have?

not legal…a long gun is anything with a 16" or longer barrel.

**Remington 870** end of story. MM or Police issue. You can get them with the 18" barrel to be legal.
Winchester 1200 would be my second choice.
