yes there is, but if you are taking the chance to do the act in the first place, then there are consequences.  
If the guy lost it by hitting gravel losing control, its not his fault and it sucks and he did not get what was deserved. If he was driving fast and out of the limits of his or his bikes control and in traffic, and lost it with being his fault its what he deserves.

And glad it wasn’t shrives!
