Ya I read that after I posted. I guess I am better off avoiding the gunshot and just getting injured on their property such as falling off their roof, slipping on their front steps for not shoveling, or cutting my arm up on broken glass.

Yup it’s called the Felony Murder Rule.

Anytime a person is killed during the commission of a felony, the person(s) committing the felony can be guilty of that murder. It doesn’t matter if the person(s) committing the felony killed someone or if someone was killed as a result of the felony.

because it’s my house, and I don’t have any family or roomates who could get their hands on it. None of my hand guns or long guns are locked up. There’s no law stating your firearms need to be locked up and secured in your own home (although it is a good idea if you have young ones)

^in florida there is a law… handguns MUST be locked up and inaccessible to minors… BUTTTT in your story… you win! hell, leave a steak knife out.

You WILL be asked those questions in court in NYS. Even if not charged with anything, your permit will more than likely be pulled. They ask 3 or 4 times where and how your handguns will be sorted when not in use / in travel / not at use at the range.
This is NYS, not AZ though.

Like I said, could be a grey area… but as the saying goes, I’d much rather be tried by 12, than carried by six.

And if you get ANY level headed judge, he’s not going to question why you left a firearm out on your coffee table… hell, you could have been cleaning it… he’s going to question why the criminal broke into your house in the first place.

that’s also what’s going on in the recent shooting near us (royal palm beach) where the kid stealing a motorcycle was shot dead from a 2nd story by the bike’s owner…the other kids that where with him are going to get murder charges. :bigtup:
