+1 on legal requirement to flee if you’re not at home, but BS on the equal force thing. It would fall under NY’s definition of justifiable use of deadly force, and the test there is a reasonable fear for your life or the life of someone else. That’s why an Amherst businessman can shoot an unarmed teacher who drunkenly walked into the wrong house and not even make it past the grand jury.
In this case I would had my wife dial 911 and I would have confronted the guy with my licensed handgun drawn but no intention to shoot unless I had no choice. The person would be told to lay face down on the driveway with his hands above his head until the police arrived to sort it out. If he didn’t comply and was retreating I’d yell to stop or I’d shoot but it would be a bluff since someone retreating is not a reasonable fear for your own life. If he advanced on me however, regardless of being armed or not, that’s a reasonable fear for my life since any reasonable person would assume things are going to go bad if there’s a hand to hand struggle for the weapon. I’m defending my own property and have no legal obligation to retreat. Announce loud enough that you’re going to shoot if the person doesn’t comply so that hopefully either a neighbor hears you giving the warning our the 911 recording can pick it up.
There’s a lot of talk about guns and shooting. And with the recent upswing in suburban robberies and break ins the chances of a confrontation in formerly “safe” areas has gone up considerably. I really hope people who have purchased guns for protection have put some thought into what a justified shooting is if they’re ever considering pulling a firearm in a defensive situation. And regardless of how right you think your shooting was don’t say anything to the police without talking to a good lawyer first. Joel Daniels would be my first call.

I saw a shadow by my garage start down my driveway upon coming out of my house. Im very observant, i followed him down my driveway and asked then if i could help him. He turned around and then i saw his face.

Did you call the Police? I guess confronting a stranger on your property, by yourself, at night, and politely walking them off is a good idea. But still, have the five-of set up on your street for the next few nights.

Found out a house down the block had an attempt not that long ago. A neighbor saw some kid trying to get in, then said kid ran off into what were RR tracks when the cops showed.

Realistically, itd just open a can of worms and my house would likely be vandalized soon after… but it would be so much fun to chase him down with a hail of paint (Perhaps some frozen)
