Unless they label him an “enemy combatant” which they can do since they did not mirandize him when he was arrested and he goes to federal court which could lead the death penalty or he could potentially be classified as a “terrorist” and be sent to Gitmo.
On the federal level, it looks like they’ll be looking for capital punishment. No Gitmo.

When I listened to that taking place on the police scanner I heard “Hold your fire, using blank rounds to fire at the boat” and “Use caution using the flash bang, may be 20-gallons of gas on the boat”. Kind of interesting listening to that and watching it unfold on the news and having the reporters freak out over shooting lol
