Here’s a quick definition from New Jersey law, specifically N.J.S.A. 2C:12-1b(2) (3)
Deadly Weapon is defined as any firearm or other weapon, device, instrument, material or substance, whether animate or inanimate, which in the manner it is used or is intended to be used is known to be capable of producing death or serious bodily injury.

OK NYS Penal Law Section 10.00 (12) says a deadly weapon is basically a gun, knife, brass knuckles, or the like.
However, anything used to seriously hurt someone is a “dangerous instrument.”
You can still get charged with first degree assault. All the verbiage says “deadly weapon or dangerous instrument.”

Oh, and if you take on 5 guys with a mag lite you’re asking to get hurt. If you take on 5 guys with a mag lite with your girlfriend present then you should break up with her before you get her hurt and go to anger classes to figure out why you have so much to prove.

If you read the story, I did nothing illegal. I was traveling at speed limits at all times.
And, I never said I pulled over, nor did it cross my mind to. I’m not dumb, I’m just saying me and my friend could have taken them if we pulled over like they wanted us to and then began to attack us. Ofcourse we would defend ourself.
My plan was to get on the 90 and as soon as I got to the toll booth I would tell the attendent that this person was following me.
They followed me for 5 minutes. Do you think that the police would have showed before that? Duh.

Besides, I know we could have taken them. I could take on 30 five year olds. So can my friend. do the math.
30 five year olds X 2 = 60 5 year olds.
20 yr old Divided by 5 yr old= 3x a five year old
30 divided by 3 = 10.
10x2= 20. Which means Me and my friend could have taken on 20 of these skrawny punks with no problem.
Do the math, it;s simple.

Officer, I pulled over to check on my car it was dark out so I had my flash light. 5 punks tried to fight me and because I was alone I had to defend my self in fear of my life so I used what ever I had to do to protect myself, my flash light.
