nothing at all. And like others said, legally I don’t think they can yank it out of your hands and hit call history… BUT that wont stop them from trying. Self incrimination is a bitch, people don’t know about the 5th amendment it seems. People get scared when an officer confronts them and if they are clueless to begin with they will buy into everything the cop asks them to do. it happens all day long, people dont know their rights and keep yappin at the gums and they cop just keep fishing for a possible infraction. And if you get ticketed for something, odds are the judge doesn’t care either and wont give a shit to ask how that “infraction” came to the surface. Its been tried on me many times, and either the cop slipped up and I caught them and didnt get ticketed, or if I was written a ticket I beat it in court by knowing my rights and double checking with a friendly lawyer, cop, judge ect I know.

not really, I have no issue paying attention like a hawk on the road, after all thats what a safe responsible driver does to avoid accidents. If I cant avoid them and crash and wreck my car, so be it, I get a new car. If I cant avoid them and crash, wreck my car, and get hurt, so be it, I get a new car, go to the hosiptal, and get a lawyer (and maybe 10 new cars!).

And furthermore… to solidify my argument that cell phone talking laws, texting laws and jogging with more than one ear bud in your head are worthless wastes of money and effort passing and enforcing… tell me this how many times did YOU get involved in an accident because of those three “causes”??? Maybe you are lucky to not have been in many accidents… well ask your parents, brothers, sisters, friends… have them explain the accidents they were involved in. ill put money on most of the causes were NONE OF THE ABOVE.

Every single accident I’ve been in was a result of someone not paying attention.
Can’t say any of those three were the reasons but it doesn’t mean that they aren’t a common factor. Asking around doesn’t make for good statistics.

pay up, because the first accident I was ever involved in was last winter… resulted from a jackass passing, to the left over a double yellow line, around a stopped car in traffic (for a line of cars a t a red light none the less)that was letting my out of my driveway and collided with my truck with enough force to spin him 180 degrees around, slide ~20-25 feet, up over a ~2’ snow bank, and clip a “welcome to ballston spa” sign post. kid was doing well over the 30mph posted speed limit in the village. Guess what…kid was found to have been on the phone a few seconds prior to the accident by my insurance company. Made my case pretty fucking cut and dry to say the least.

Which is supposed to mean they are statistically insignificant, but I’m sure with the number of teenagers getting licenses every year and cell phones being as common as they are now, those accident’s are probably pretty frequent. Arguing it would be akin to saying that insurance companies single out young riders with fresh licenses on sportbikes. Statistically they crash A LOT, regardless of the exceptions on this board.

Guy in bold can get a ticket. By yielding someone into traffic assumes the risk of the situation. NEVER I dont care how nice you think you are, let someone out of a drive into traffic by waiving them on.

My brother found that out the hard way. We did the SAME thing you did, went to pull out of a parking lot 15 feet from a red light where its 2 lanes north bound center lane and 2 lanes south bound. North was stopped for a light, most of the cars in the left lane and noone in the right stopped at the light. guy gave my brother room, waived him on, nothing was coming south bound (where we wanted to go) and nothing was coming north in the empty lane, UNTIL some impatient asshole said fuck this long line and booted it around the line of traffic he was in, in the left lane and gunned it towards the right lane… taking out our front end.

Guy that let us out would have gotten ticketed. A off duty fire guy saw the entire thing and pulled over to be a witness. the guy that waived us on pulled over too, and the fire guy said he should take off because he would get a ticket. the guy that hit us didnt have insurance, went to court, the while 9 yards.

Valid point. Young kids crash all the time because they done have seat time to know how to react to things. I can see how putting a phone in their hands would make it worse, especially when they ave 10K texts a month. But so would not knowing how to modulate the brakes, steer, adjust speed for conditions, understand how a car works and reacts, how big their car is!.. basic shit.

I wish this was a law in Fl on 11/24/2010, 100% would have prevented the idiot texting from rear ending me…oh wait, no it wouldn’t.
