they advertised the car to the best of their knowledge…if it wasn’t modded when it was traded in, how are they supposed to know. Do your homework before you put down the deposit. You are not entitled to the $100. If they give it back, it’s a customer service move more than a legal move. Consider the fact that you probably saved more than 100 dollars worth of hassle/money that you might have spent on repairs from owning a hack car.
Not getting a call back sucks, but in their defense they probably feel they’ve put enough time into this “non-sale” that you’re not longer a priority. IMHO you’re not really entitled to the deposit back. The dealership wasn’t hiding anything from you and most likely didn’t even know about the car’s modded past. They negotiated in good faith and you gave them a deposit on an agreement to purchase the vehicle.
If they want to spend $100 on PR (or to just make a squeaky wheel go away) and give you the deposit back cool, but if they don’t I doubt you’ll get much support badmouthing the dealership telling this story. Maybe if it was a higher dollar deposit, but for $100 I’d hear this story and side with the dealership.
Jay is right about the point of a deposit being that you are putting down money on the car because you are serious about purchasing it, so much so that you’re willing to put $100 at stake in case you change your mind.
However, since the car was misrepresented (according to you) I do believe it’s an exception to the rule and you should get your cash back.
Also, if you don’t get the cash back, take solace in the bad PR you created for Paddock - on a website frequented by members of its target market.
How was the car misrepresented?
The dealership didn’t know the history of the car…It’s also a “performance” car regardless the expectation being it was driven like a performance car.

I’ve gotten deposits back from dealerships but I am also smart enough to get it in writing it was given and that it is refundable.
This is a dealership we are dealing with not some lackey in the southtowns that wrote NON REFUDIBLE on the back of a reciept from napa.

I don’t know what dealership’s you guys go to but I have always walk back with the sales guy to the cashiers desk to get my receipt that says refundable. If they aren’t willing to do that then I’m not buying the car. I’ve only pulled out of one deal after a deposit was given and had no trouble getting it back.
Seriously go get your deposit. I have only backed out of a deposit once and all it took was a quick phone call and the dealer immediately gave me my money back.
However I do firmly believe that Paddock sucks so good luck.

to the couple guys that think buying a modded car is a flawed idea. I would disagree. It can save you a massive amount of money on stuff you were going to do anyway. The fact that the car has been returned to stock sucks for you but that does not mean that this car was hacked up just because it had some bolt on’s. It is not like you are buying one of my turbo projects where half the fucking car is custom. Unless this is a great deal I might have to side with your decision to keep looking but I would disagree that you are entitled to your deposit back. The money is to hold the deal for you end of story. They will likely give it back in good faith though. Instead of calling and getting all worked up just go down in person. keep in mind that they might just be busy as hell so a in person visit can solve this really fast.

Seems pretty extreme. I mean honestly what’s it cost in gas to drive down to the dealership? $10 maybe? You seem like a reasonable person Tim, and yes calling paddock and getting anything done is a chore. However, that being said, the new car general sales manager Bill is a family friend and I’m sure if you went in there and explained the situation he would be more than willing to refund your money to you. Hope all goes well, but like other said usually if your giving out a credit card number they will most likely charge it. I’m pretty sure when I just purchased my Evo this past summer that if I backed out the $500 on put down on the spot for them to secure the car would have NOT been refunded.
