ATTN NYSpeed lawyers: What are the legal liabilities associated with...

That sounds like a good plan. Then the responsibility is on the dealer to fix it.

ot:
what are you going to ask for your truck?

Dealerships do sell cars with no warranty expressed or implied, mostly at auction, but an average customer can buy a car in such a manner.

Not legally. Trust me i"ve taken many to court for it

then what is the point of that paper in the window that states if the car is warrantied or not, and what about cars with over 100k that aren’t covered under the lemon law?

i was able to buy a grand total of ONE “no warranty at all” car from schmitts in the 5 years i worked there.

this is only because in all reality, the salesman himself bought that car off the customer during the trade in / new purchase process, as it was so shitty that the dealership didnt want to give a cent for it, but the customer wanted SOMETHING for it.

even then i had to listen to a bunch of shit from the schmitts because the car was on their lot / traded in by one of their customers. also didnt help that the title was filed w/ the sale paperwork, so it had to be retreived by the schmitts

Ok slow down now. someone said “as is”. theres a big difference between a waranty and as-is. Lemon Law is through the arttorney general and i know a little but not a ton about it. Used Car Certification is a NYS Dealer law that states- At the time of sale the car is road worthy. Does it cover BS such as window cranks- no, but DMV judges hold any system that causes a vehicle to run, stop, safety standards to be in good condition at the time of sale (and 30 days there after). NO matter how much you pay for it. If you were to buy a car from a registered dealer for $1.00 it has to be in condition to give satisfactory service and it has to be NYS inspected.
Dealers love to say it’s as-is. Thats so you dont come back on them for anything. But it dosent hold up. Theres a whole section in Dealers Regulation (CR-78) www.nysdmv.com in regards to it. There are also things in used car cert that go above and beyond inspection(ex. BJ’s not part of inspection- Used car cert are)

mine wasnt even road worthy, i had to replace all the fusable links by the starter just to get the car to power on, then i had to do a bunch of maint work and throw an exhaust on it

and then i drove it w/ the bad ass steel on steel rear brakes so i could scrounge some new brakes from the JY

that piece was defianantly as is, lol… but for $300 all spent it managed to pass inspection … but only cause Tomahawk pulled it in, poked at it with a screwdrive a few times and replaced a tail light bulb

the inspection sticker came with a warning … “your going to die in this car” … 4 month later i was making new rear strut towers out of pieces of body panels from the scrap pile

edit: schmitts even registered it for me in my name, score

fuck it no body needs airbags

HRK im curious as to what the car was

good thing i dont do the things i think up lol.

Brian

89 grand am. the car was so rusty that the day i locked the keys in it at the galleria, i simply kicked a hole thru the door skin to access the rods that attach to the latch

when i rebuilt the strut towers in back i simply hosed down the interior so it wouldnt burst into flames, didnt bother with welding blankets or cardboard “walls” to contain my sparks

interior detals were easy, wash ENTIRE interior with soaking wet wash mit, rinse with hose till all the soap is pooled on the floor of car, vac dry

oh, and those fusable links i had to replace … i just used crimp connectors

buy it and ill drive it home for you

your ‘feeling’ has no merit. The mechanism was placed there to defeat the safety electronics, deliberate intent. Not accidental. Not “my CEL light is on and I forgot to get it checked out, but you should”. This does not fall into the “no warranty implied” discussion.

Follow the bouncing ball: The next owner gets into an accident where the bags fail to deploy…newman is liable. Assuming they trace the history back to him - and that one should be easy. Liable. Liable. Liable.

Selling anything “as is” does not provide you with a universal get out of jail free card.

Not actually servicing it properly is something a poor person would do.

Make them sign something saying they realize they are buying a car without an airbag.

God forbid you buy a car without airbags :banghead:

That’s bullshit.

lambo > ferrari

You are a fucking idiot.

My point is, if someone buys a car WITH airbags, they expect them to work. If you disable them to save a few dollars on trade in, YOU are an asshole.

How funny would it be if you crashed your EVO and the airbags were nowhere to be found?
