H-1Bs have been around forever.
The jobs must be listed publicly and if a qualified US citizen can do the job, they are supposed to get it.
But, it is also legal to change the job description and start the process over again if you really want a specific person.
I did not look any of that up though, so… I could be wrong on what the law requires.
