Work your way up the chain with Allstate. You can file a NYS insurance department complaint. Just make as much noise as possible, but no guarantees that will work all the time.

Otherwise, I dont know if you posted this or not, you could use your own collision coverage and then let your insurance company deal with it. They will handle your damages or if the car is totaled and then subrogate against Allstate. If Allstate still wont budge, they will take them to arbitration which is binding.

If your insurance is successful in getting full subrogation from Allstate, they will also get you your deductible back.

its totalled, and even if it isnt you tell your insurer that it it beyond repair and that you would not be interested in driving it even if it coule be repaired within the ICV.

I guess it depends on the value of the vehicle and Allstates formula for that. For the company I work for 65% or greater of the value of the vehicle means a TL. I dont know what Allstates formula is. I have a 2008 focus as my company car and it cost about $15k new. So, just for numbers sake 10k/15k = 66% = TL in my book.

I guarantee when they start the tear down, they will find more damage that will total the vehicle… problem is, they will most likely already be started on the repairs and wont want to total the car at that point.

Find out what value they are putting on your vehicle and the exact amount of damages. Ask them what their formula is for totaling the vehicle and go from there.

Here is a guy that had a similar problem with Allstate on his STI. 23k in damage and they didnt total it. IIRC, they found more damage later that still would have totaled it in their books and didnt do it. I believe he obtained an attorney and fought them for diminished value and won in the long run, although he never posted about it.

Why would they though? Paying 100% and taking a brand new car which will get them decent money back > Paying 100% to a repair shop and getting nothing.

NYS can fix 100% cost of the vehicle. if it goes a penny over the value of the car to fix it they will total it
