If you take the breathalizer you don’t have to worry about having your blood “taken”. If you’re not driving drunk, you have nothing to worry about. Ask the parents of this little girl if they think this should be a problem. I don’t like the degradation or marginalization of citizen’s rights, but there’s too many people out there driving drunk (repeatedly) and killing people who don’t make the choice to drive drunk.
This thoughtless piece of shit decided to go on a bender then get behind the wheel and change a families life forever. There is no amount of jail time she could serve to bring the families child back and make their lives what it was. With a child of my own, I can say that the safest place this girl could be is behind bars. I’m not attacking you or this post, simply saying that maybe the guy / girl that goes to jail because of getting caught this way, might not be out another night to kill others on the road.
The government should really take a database of everyones DNA to solve crimes.

If you look at my other other posts I was all for extremely long sentences for people convicted of DWI…A better approach to this would have just been severely increasing the punishment for refusal laws.
The video states that they do obtain a warrant. While I agree with you in part, how many drunk drivers that have their license revoked continue to drive anyway. The only option for refusal woukd be immediate jail time.
So… you’re saying that baby would have lived if there was a blood test? Or are you using the sensationalization of a recent case to further your agenda, although blood test would have no direct affect on the circumstances of that day.
There are states that DON’T have to obtain a warrant that is the entire argument about this topic.
Getting a warrant for blood tests/DNA has always been normal
If there is any reasonable doubt you shouldn’t be driving, don’t drive. I have no sympathy for people who lack that common sense.
Our “drunk driving” problem stems from a “lack of punishment” problem. Shit, I personally know a handful of people who have had 2 or more DWI’s.
In certain countries, they’ll take your license away forever for drinking and driving. Too bad America is full of entitled idiots and people who are too afraid to hurt anyone’s feelings.

You want to stop drunk driving? First time offense, 5 years no license and many years of alcohol classes just to make your life miserable. When you do finally get your license back, you have to have a bright red license plate. Public humiliation/shame and police targeting work wonders. Thousands of dollars in fines. This $500 BS needs to stop.
2nd time, hard jail time…I’m talking several years and permanent revocation of driving privileges. Hooray for mass transit!!

No, simply saying that there are instances where refusal might allow drunk drivers to “get away with it”. I know some are repeat offenders, but I know there must be some who learn their lesson the first time. Refusal might allow that lesson to go unlearned. Danielle Kellogg was convicted previously of DWI before this accident. Unfortunately, she didn’t learn her lesson and I think it would’ve gone on that way until someone was killed. Not trying to “sensationalize” but this accident happened no too far from where I live and on a route I travel quite frequently.
I wasn’t sure of you were referring to the state being mentioned in the news reel. I’m not sure how I feel about obtaining a warrant for something like this. Are you saying it’s OK as long as they have a warrant?
I completely agree with you on the leniency of punishment. Another hard bite might be to revoke the license AND confiscate the vehicle. There might be less of a chance they’d be able to drive without a license. I personally know a guy in the southtowns who REPEATEDLY drove beyond the limit and finally had a non-injury accident. They gave him a restricted license and an ignition interlock system, but he still drives other people’s cars and gets around it. It won’t really be put hard to him until something serious happens and then it’s too late. No excuses for this guy either. Good job, makes good money, good looking, athletic, drives nice vehicles, etc. Simply cannot take responsibility for his actions.
