What’s with all the math?!? Whats with trying to justify drinking and driving? If you are going to be drinking take a DD with you. There are also times where you can get a taxi for FREE in buffalo.
There’s just no excuse. Its cheaper to drink at home anyway.

and there are PLENTY of people out driving with multiple DWIs.

My point is that it isn’t always about the severity of the punishment, but rather the responsibility lies with the person.

In Andy’s case this may have been enough, or perhaps on the other hand if he was arrested/cited there is still the chance that he would drive and drive again. I bet there are people on here that have DWI convictions that will do it again. I can think of at least 1 (no offense, but you are still young).

It was more of a ‘what if’ argument to convey my attitude for no tolerence or ‘freebies’ when it comes to driving drunk. (not aimed at andy)

I’ve gotta say, I’m kinda surprised by Andy’s posts in this thread. Being anything but grateful to the cops that let you off for a 0.XX is insane. I really expected him to go one way with it, and then he totally turned the other way and seemed to take the whole thing as a joke.

I’d be all for harsher punishment if they went back to the old .10 standard. .08 was pushed through by bullshit politics paid for by the insurance companies.

Want to see how much they like to twist the fact that .08 is bullshit? Check out this quote from a CA department of drugs and alcohol study:

Most DUIs occur at night (9 p.m. to 6 a.m.).Sixty-nine percent of the drivers of nighttime single vehicle fatal crashes had BAC levels of.10 percent or more. Only 21 percent had no alcohol in their blood.

They assume you won’t do the math. 69% were over .10. 21 percent had zero alcohol. So the people with less than .10 but more than 0 only contributed for 10% of the crashes. Or to put it another way, they were 11% LESS likely to crash than the stone sober drivers. How does this make sense? It’s actually pretty simple if you’ve ever actually driven with a slight buzz. Driving at .08 is the most concentrated you’ll probably ever drive. No cell phone, no texting, no speeding… nothing. Just concentrating on being that perfect driver so the cop has no reason to pull you over.

Yeah, studies have shown your reaction time isn’t as fast, but I’ll take my chances with the guy with the reduced reaction time who’s paying 100% attention over the guy who’s speeding and texting.

Ugh, this always happens on here. Everyone tries to be the cool kid taking a hard-line stance against DWI when most of them do it/have done it or completely misperceive how it actually is. Anything to the contrary just gets a bunch of stupid “Why do you support drunk drivers? EXECUTE THEM!!!1111111111111” responses. I tried making the points that Static does for awhile, i don’t bother any more.

If you lined up 20 people in a bar, 5 of whom had a .08 and the rest with a 0 or a .02, i bet most of you bashing wouldn’t be able to pick out 1 or 2 of them.

And Newman has more right than most to his opinion on this, but since he doesn’t drink it’s harder to take seriously. He could have an entirely different perception of the actual experience of being drunk, or even what a .08 feels like. Like a priest preaching about unsafe sex.
