In New York state if the car was originally equipped with a third brake light, it has to be present and working at the time of inspection to pass. But since you have taken it out completely, most shops likely wont notice it and you probably get away with it because they see no previsions for it and have no idea what it came with without looking it up, and they are too lazy for that.
