Got Ripped off! what to do??

I give people and companies about 25 seconds of my time being nice while resolving an issue I have. I am a sound reasonable person but if you don’t fix my problem asap I turn unreasonable pretty quickly. I just straight up don’t have the time to waste trying to convince you that you’re wrong. Give me a call once you figure out how you messed up and how you’re going to fix it for me.

Also paying $300 for a phone seems pretty funny to me. It would have to be some sort of killer phone for me to pay $300 for it then an additional $150 per month. For $5700 I could have a very fun car/dirt bike/motorcycle etc.

The fact that most of the replies after the OP were basically asking him to do what he already tried to do, is what I do not understand.

Was the first post changed from when I was reading it versus when other people were reading?

Now, with the issue here, basically this is what I can see that can be done.

  1. Sprint isn’t really going to do anything, but I would throw out to a manager there that you are filing a complaint with the BBB and the AG’s office because of one of their resellers not following the rules. They most likely won’t/can’t do anything but give it a shot. (If you have a contract get them to cancel it with no fees, or something like that.)
  2. Go to that wireless place and give them the same thing about the complaints to the BBB and AG, the AG thing might get a bit more weight because they are being shady. Also, the fact that the manager there lied to you about the first phone being “reused” currently. Which you already confirmed with Sprint that it is in fact not being used. So, you can really turn the heat up on that fact that he is lying to you.

And then next regardless of the outcome file complaints at BBB and AG’s office over the whole issue. I would most definitely cancel my contracts and look at going with another company.

Filing with the BBB is probably the quickest resolution. Quiting your contract (usually a huge $300+ fee) is a bad move. Honestly Sprint couldn’t give a fuck whether you are a customer or not, they don’t care about your feelings and they sure as shit don’t care that you fucked up and bought a phone from a kiosk that you thought was an authorized dealer. Your mistake, you learned your lesson, hopefully you can get some sort of refund. I don’t know the whole ins and outs of your contract, how More Wireless works, Palms warrantys and Sprints service, but I would hope they would give you another phone. Even if it is a shitty Palm Pre.

Well, from what I have read so far is that More Wireless selling a refurbed phone as new is against some laws.

Which, should be enough that if you are going to report them for this that something should get done?

But then again, maybe I am bring naive to think that More Wireless even gives two shits about what laws they are breaking.

Buy a cheap ass phone that works to swap your sim card into until this is all settled up.

Persistence is KEY. When you’re at work call the same managers as much as you can. Just call and leave it on speaker until you can talk. The squeaky wheel gets the grease. They will cave in and give you what you want so you leave them alone. Waste as much of their time as possible while minimizing your wasted time. Call on your way to work or while you’re pooping. Call when you’re watching tv, its ok to put them on hold to wipe.

Call bbb etc etc and file a claim.

There isn’t much you can do quickly if Sprint isn’t going to help you out.

I filed with the BBB, gave Sprint some negative reviews on their customer service surveys and am going to the Sprint store today to see about options regarding a new phone

You filed a BBB complaint against Sprint, which won’t hold any water because Sprint didn’t cause your issue, and don’t have to do anything about it. Its going to be dismissed. In order to get anything, you’ll have to go through More Wireless.

From your original post you haven’t stated about your original warranty, the warranty on your original palm pre phone, does it say you get a brand new never opened unit to replace your used phone, or just a replacement unit? Your warranty might have been voided out after so many claims on it too, can you post a copy of it?

I realize it should be filed against More Wireless however filing it online it cannot find a record of them by name, address or telephone number

All Palm Pre’s are warrantied by Palm for 12 months from the original activation date, I believe all replacements are remanufactured phones, I dont have a copy of it, this is Sprints policy regarding the Palm Pre…

it wasnt voided I was told the original phone was a remanufacture , the warranty started with whoever owned it first which must have been over 12 months ago…

I upgraded to a HTC Evo today, trying to figure out how to use it and put the Pre bullshit behind me until I hear something back from the BBB…

UPDATE-

after contacting the BBB and being put in touch with someone at Sprint who could help me I got the original purchase price of the Palm Pre credited onto my account today
