Man ejected from bills game, found dead in creek need stadium

I was implying that if you’re drunk and in public and something bad happens to you, you and your actions probably played a small part. Death, injury or embarassment.

"The NBC affiliate in Rochester, WHEC says the man’s name is David Gerken, Jr. of Palmyra. They spoke to his parents, who told the station that somepoint during the game, Gerken told his brother he was going to the bathroom. They beleive Gerken was asked to leave the stadium. Gerken’s parents say he called his brother and told him that he’d meet him at a bar down the street and took a shortcut. He apparently climbed a fence before falling and hitting his head on a rock.

Gerken’s parents told WHEC they are aware of the reason Gerken was asked to leave, but they did not want that information out. 2 On Your Side is following up with police on why Gerken was asked to leave the stadium."

"Car Hits House; Driver Faces DWI Charges

A Palmyra man faces DWI charges after police said he lost control of his car and then hit a house.

The Wayne County Sheriff’s Office said the incident happened late Tuesday night on Vienna street in the village of Palmyra.

Deputies said David Gerken, 24, was driving drunk when his car went out of control, striking the home.

The house suffered heavy damage. The person inside the home was not injured.

Gerken will appear in Palmyra Town Court at a later date."

I’m sure Fry is right, I’m sure he wasn’t drunk.

Hes obviously done this more than once if he knew a “shortcut”, unless he was following the sweet scent of Genny Light lofting from the bar.

He obviously learned a lot from his DWI. Am I glad this kid is dead? Absolutely not. Am I sad at all? Absolutely not. His actions led to his death. I would have felt bad if he just got hit by a car crossing the street (like the kid at darien lake)- but in his situation, he obviously has a history of bad decisions and its only a matter of time before those bad decisions catch up to you. How you drunkenly run a car into someones home and still decide to drink after that is beyond me.

I am guessing there will be a lot for the defense to work with when they decide to sue. I assume he was trespassing by jumping the fence. They can probably play the trespassing card when he decided to get visibly intoxicated at the stadium as well-- I’m sure there’s notices posted somewhere that says this is against stadium rules.

It’s good for Ralph that he was just taking a shortcut and not so hammered that he aimlessly wandered into the creek. Pretty unlikely it ends up in court based on that.

They will sue the person who put a fence up forcing people to jump over it-- and how DARE THEY not put a sign on that fence explaining the dangers of climbing over it. They will sue his brother for not coming out to drive him home. Whether these lawsuits ever see a courtroom is another story but…Families try and place the blame on everyone else.

I remember reading an article where a driver tried to sue a person for pulling them out of a burning vehicle, but ended up paralyzed or something. Let me try and find it.

Yeah, she was in a serious car crash or something and her best friend pulled her out and she became paralyzed, then sued her. Some people just fucking suck.

Good samaritan law prevents that.

The court majority said the 1980 Emergency Medical Service Act, which Torti’s lawyers cited for protection, was intended only to encourage people to learn first aid and use it in emergencies, not to give Good Samaritans blanket immunity when they act negligently.

He said the ruling will force ordinary people to be “reflective” before coming to the aid of a person in an emergency.

“It’s much too literal an interpretation of the immunity law for Good Samaritans,” he told ABCNews.com. “Now it puts the onus on the lay person in an emergency situation to try to figure out the nuances of what medical care means, something that could subject them to liability later on.”

If you help someone you take the responsibility for it.

Well you can always be sued for anything.

I’m gonna sue you for saying I can be sued; that’s entrapment…er, something.

My understanding of the situation is that he was sitting outside the gate, shivering, in the cold waiting for the game to end, so he could meet up with his brother. But a NOCO rep called and said the symptoms he was feeling was not from being drunk, but not being drunk enough (as that would help him feel warmer). Based on that advise he went looking for the nearest source of replenishment.
