OK NYS Penal Law Section 10.00 (12) says a deadly weapon is basically a gun, knife, brass knuckles, or the like.

However, anything used to seriously hurt someone is a “dangerous instrument.”

You can still get charged with first degree assault. All the verbiage says “deadly weapon or dangerous instrument.”

Oh, and if you take on 5 guys with a mag lite you’re asking to get hurt. If you take on 5 guys with a mag lite with your girlfriend present then you should break up with her before you get her hurt and go to anger classes to figure out why you have so much to prove.

While I agree with you, and no, I would never have gotten out of the car, I was just throwing that out.

But here: What sounds better.

Officer, I pulled over to check on my car it was dark out so I had my flash light. 5 punks tried to fight me and because I was alone I had to defend my self in fear of my life so I used what ever I had to do to protect myself, my flash light.

OR:

Officer, I pulled over because these punks were following me, I grabbed my (baseball bat,knife,brass knuckles) because they were going to attack me. I know I did a lot of damage but I had to defend my self.
