NYS Bans Drivers from Idling Cars While Unattended

I read this regurgitation of an article this morning and had to laugh. “idling is the second hand smoke of the out doors” That a specially made me laugh.

No, you’re supposed to scrape them off. You can even do it while the car is running since it won’t be unattended if you’re standing there clearing the windows.

What if I watch the car from inside my warm house? Isn’t it the same thing? I mean at what point does the car become unattended?

Pretty sure the moment you walk away from it.

BTW, I too think this is just another money grab from NY. I’d love to see the stats behind how many cars actually get stolen while being left idling to warm up. I’m not talking about the retards who leave their cars running while they go into a store to grab something quick, but the people who are starting their cars up in the morning before work and letting them run in their private driveway for 5-10 minutes. I’m guessing its a pretty low number, especially considering anyone who lives in a shitty enough neighborhood where the car is likely to be taken in such a situation wouldn’t do this in the first place.

They’ll probably lose more in disability payments from fat cops falling on their ass walking up snow covered suburban driveways to see if that running car has keys in the ignition or is using a remote start than they’ll make in ticket revenue and reduced stolen car recovery work.

If my car is sitting in my garage running with the garage door open, is it criminal trespass for the officer to walk into my garage and look at the car?

I’m guessing a lawyer would argue if the simple act of seeing a vehicle idling was reasonable suspicion for him go to into the garage on private property to check for keys. With car starters being so popular in this area I think simply seeing a car running would make that a tough sell.

A better question is how long before a NY cop is dumb enough to do this with an undercover car and finds himself looking down the barrel of one of the thousands and thousands of guns reasonable homeowners have decided to buy to protect their property? That would be a real awkward and dangerous situation for everyone involved.

Right, this is nothing new, it’s been on the books for quite some time.

A cop can not walk onto your private property to check to see if there were keys in your ignition. Reasonable suspicion to believe that someone has left a car unattended on their own private property would be pretty funny to see them prove it court. Sure they could do it, but I don’t think they could get away with it. If anyone cared enough they could buy all these law books which are pretty cheap actually and read for themselves what exactly cops can and can’t do

What is attended? Do i have to be at the wheel? Can i idle it while i check the tranny fluid? Can i run in my house to get something with the car running? Can i check for an exhaust leak while under it?

Or is it a vag POS law used to fuck us over?

Are cops exempt like the smoking, cell phone, seatbelt, etc, laws? I think EAPD cars spend at least half of their time idling.

The other half is spent at WOT chasing down teenagers on main street.

Let’s not be stupid, immature and go overboard with this.
This law will be enforced more or less in public areas, like running into the store ect.
It’s been on the books for awhile but like all of these other little laws, attention is brought to it, it will be enforced maybe for a little while, then interest and attention will die off.
It’s also against the law to let your vehicle idle while filling it up at the gas station, but I’m sure some of us have done it, has anyone been ticketed for it?

Pick up a NYS V&T law book and read up on this if everyone is that concerned about it?

Just get your windows tinted and they cant see if the key is in the ignition or not. snky snky!!!
i didnt have a remote start so i would just turn on my car and set the turbo timer to 10minutes to let it warm up in the morning

You honestly do not know how many people say “uh, you left your car running” I wonder if they wanted to steal it, were worried about me getting a ticket, or actually thought i forgot to turn my car off?
