You didn’t sign it, if you genuinely did not sign it, state that you didn’t sign it.

It may be notorized, but you hold to it, in a professional manner that you did not sign it, and you have no idea who the notary is. all they need is a little bit of forensics and they can tell its a fake sign. Even the best forgeries can be proven fake.

Definitely sounds like something that should be counter sued… but talk to a lawyer and see where you stand. I’m pretty sure you can postpone things… for just about every reason

She’s sueing me for the rest of the money she borrowed from her Mother to buy the vehicle she says I traded in, which is $2800.00. I was stating I didn’t have a trade I put $5000.00 cash of my own money down.

I would imagine that you can have the notary court ordered to have to come in a testify. I mean she is the only proof this lady has and if she can say she signed it without your signature,that would get the ex on forgery.

Is this said vehicle still around? If it is find out who owns it and bring them with you, to say that they bought it from her or whoever they got it from.

Well, if she had your signature forged then you really need to find the notary public who put his or her stamp on the documentation. The signature needs to be done in front of the notary for it to be official. Get the notary on the stand and she or he will crack because that is a serious misuse of title and power which = mucho jail time and fines.

If it is forged like you say it is you can even try and have a Handwriting Analyist take a look at the signature on the document and your actual signature. Odds are that they are not the same in his eyes. For a few reason actually

  1. Female vs Male handwriting is very different.
  2. Angle you sign the signature or naturally write.
  3. Pressure and with of the ink.

Most police departments have an investigator trained to do it so maybe give them a ring.

Only things I can think of for now.

Well if the Notary didn’t witness HIM signing the document…then she is in big trouble. She will never be a notary public again if she abuses that power and other consequences of course. That’s why she doesn’t want to go to Court to help him. I would have tried gathering more info, records before Court…and shouldn’t your attorney be guilding you on this? He/she should be able to tell you where to go to get the info you need and what they actually need to prove your case. Good luck. i’m interested to see how this goes

thats kind of what i thought. If he is telling the truth, this should be an easy enough case. Just forging a signature is easy to prove as fake

UPDATE: The Judge signed a subpeoena to bring the notary to court. The new court date is August 10th. I talked to the notary yesterday and she tried to tell me that she never signed it, and that this girl is forging her name, and she’s gonna get her lawyer to bring up charges on my ex as well. My ex also told the judge that she’s gonna bring a handwriting expert to analyze my signature, so she pretty much took care of that for me. Either way it’s looking really good for me.
