Overtime question

if its seasonal you dont have to get time and a half by law

http://www.labor.state.ny.us/workerprotection/laborstandards/faq.shtm#4

Yes, anything over 40hrs must pay overtime. There is a Class Action lawsuit against the company I work for now because they didn’t pay us overtime the first 4 years I worked here. The lawsuit only goes back 3years though.

It was my old employer. I got my paycheck form the new one and thought time and a half was a bonus. Then someone there mentioned they thought it was the law. I searched NYS Dept. of labor and didnt see anything so thanks for the help guys.
I got paid by the hour.
I have one stub that has O/T on it with time and a half rate. the rest are just straight pay. One was a 51 hour work week.
Now I just need to figure out what to do

Thanks again

if you work for a big company go to HR. Do not give them originals of your paystubs if they ask, give them copies so you can always have proof.

Yeah, API on Walden does time and a half after 8 hours, then double time after 10 hours… and time and a half on sat (even if you only worked 20 hours M-F) and double time on sun.

Does anyone know if this applies to the Indian Reservation???

its not a big company at all…

Doesn’t matter, go get your money. I hate seeing any kind of company screw over their employees. ABSOLUTELY do not do nothing about this, or they’ll continue to do it to future employees.

They already have, I thought being at a small company would be nice. They lied to me, broke promises, and after they let me go, are trying to deny me unemployment, making up a bunch of lies to try to make sure I don’t get it…

Should I just contact NYS Dept. of labor directly?

Do you have a lawyer?

No, I take it i should be making some calls…

Walmart has been fined millions upon millions of dollars for doing this.

wow. sounds like my job.
