John Colazzi, acquitted today, said he hopes to be reinstated to school duty shortly.
John Colazzi, the Buffalo schools teacher’s aide accused of molesting a 4-year-old autistic kindergartner in a bathroom two years ago, was acquitted today.
In a terse verdict following a non-jury trial, State Supreme Court Justice John L. Michalski found Colazzi, 62, “not guilty” of both first-degree sexual abuse and child endangerment.
The charges stemmed from an alleged incident at Discovery School 67. Colazzi was indicted by an Erie County grand jury for allegedly molesting the boy during a bathroom break at the school about 11:30 a.m. Nov. 14, 2007.
Colazzi, still a defendant in a civil suit filed by the parents of the now-7-year-old boy, said “I’m very happy and I believe in the justice system.” Advised by his lawyers not to speak too much because of the ongoing civil suit, he said he hopes to be reinstated to school duty shortly.
Colazzi, a teachers aide for the past 12 years, had been suspended after the alleged incident. He had been free on $5,000 bail and did not testify at the non-jury trial he requested. He had faced a state prison term of up to seven years if convicted of the sex charge.
Leaving court today, defense attorneys Thomas P. Hurley and Paul V. Hurley cited what they called the seven different versions of the alleged bathroom incident that Charlene Harris, the special-education teacher Colazzi was working with, gave to authorities.
Harris testified that she saw Colazzi molest the boy while she was caring for three other children in their special-needs class during the bathroom break.
During the trial, defense attorneys cited reports that the boy’s behavioral problems – which prosecutors had linked to the alleged bathroom incident with Colazzi – had actually started about a month earlier.
So, it was the boys “behavioral problems” that lead this man to molesting him…
I dont want to know the details about the “act”, but has an adult why would you put yourself in a position that you would even be accused…
