Teacher's aide acquitted of molesting boy

John Colazzi, acquitted today, said he hopes to be reinstated to school duty shortly.

John Colazzi, the Buffalo schools teacher’s aide accused of molesting a 4-year-old autistic kindergartner in a bathroom two years ago, was acquitted today.
In a terse verdict following a non-jury trial, State Supreme Court Justice John L. Michalski found Colazzi, 62, “not guilty” of both first-degree sexual abuse and child endangerment.
The charges stemmed from an alleged incident at Discovery School 67. Colazzi was indicted by an Erie County grand jury for allegedly molesting the boy during a bathroom break at the school about 11:30 a.m. Nov. 14, 2007.
Colazzi, still a defendant in a civil suit filed by the parents of the now-7-year-old boy, said “I’m very happy and I believe in the justice system.” Advised by his lawyers not to speak too much because of the ongoing civil suit, he said he hopes to be reinstated to school duty shortly.
Colazzi, a teachers aide for the past 12 years, had been suspended after the alleged incident. He had been free on $5,000 bail and did not testify at the non-jury trial he requested. He had faced a state prison term of up to seven years if convicted of the sex charge.
Leaving court today, defense attorneys Thomas P. Hurley and Paul V. Hurley cited what they called the seven different versions of the alleged bathroom incident that Charlene Harris, the special-education teacher Colazzi was working with, gave to authorities.
Harris testified that she saw Colazzi molest the boy while she was caring for three other children in their special-needs class during the bathroom break.
During the trial, defense attorneys cited reports that the boy’s behavioral problems – which prosecutors had linked to the alleged bathroom incident with Colazzi – had actually started about a month earlier.

So, it was the boys “behavioral problems” that lead this man to molesting him…

I dont want to know the details about the “act”, but has an adult why would you put yourself in a position that you would even be accused…

To get my son to do it, I had to 1st teach him by letting him pee on/over trees outside before he would try it in the bathroom.

I can’t image how difficult it would be to teach a kid with special needs.

It does not sound right, if a child has a behavioral problem you’re supposed to reinforce the good behavior and not the bad behavior, basically letting that run its course. So even if he was trying to reprimand the child he is wrong and just supporting the bad behavior.

Maybe since he was acquitted, he actually didnt do anything.

Anything could have looked like molestation. If the kid is taking a shit on the floor and you grab his ass, is that molestation? It’s a 4 year old special needs kid. He may very well have not been potty trained or was acting up.

yeah, this could have been anything. Taking measures to avoid a massive shit/piss mess, is NOT a sexual act. It may be kind of gross, but when you work with special needs kids, this stuff happens.

No one said his behavioral problems lead to “molestation.”

Edit: Also, my grandmother has worked with developmentally disabled individuals for over 20 years. Yes, she has to clean their nether-regions, because if she didn’t, they could develop infections from poor hygiene. There are individuals out there who can’t do everything for themselves, and other, very kind human beings, take on the task to do it themselves. If everyone choose not to “put themselves in that position,” then we’d have a lot of other people living at a sub-standard of life.

Well, then I think maybe some type of measures should be put in place, to help the people who have to work there and the students who have to go there.

The boy must have needed some further attention, now I dont know why one care taker had three kids and the other had one. But maybe the buffalo schools need to look over thier procedures on cases like this.
