wait…thats what I almost hit when I text while I drive… as i did, on 87, in the storm. I know I wouldnt be doing such a thing if I wasnt so drunk. I think that texting while driving should only be illegal when your smashed, I mean thats alot to ask for anyone to do while maintaing a low crash average.
For me, i will take the plunge, and no longer text while smashed, and driving.

Doesn’t exist. Heavy traffic on the thruway = 7:30-8:40am or 5:10-6:30. You cant do 80mph. in fact most of the time, you are fucking stopped. You apparently are the person who follows too close and are in 6 point moving violation teritory in the scenario you typed above. If you follow a safe distance, have good peripheral vision and can visualize your car on the road with traffic, and visualize what ever else you may be doing… you will be safe. If you only have a spilt second to react and you have to jam on your brakes, you are too close or have not been pay attention for a lot longer than your split second. Drive like a semi truck driver in heavy traffic. You rarely see their brake lights. They engine brake, and think/look a head.

OK again, yes texting requires SOME people to take their eyes off the road. 2 people said they can instinctually text because they do it so much and know the functions of the phone. And again, some people can change the radio without looking, some cant. Listening to music is out of the question, because you don’t see music. Shifting again, some people for what ever reason look at the shifter to shift! it is retarded, but it happens. Others do it with out looking. Talking on the phone, once the phone is answered/dialed, is much like music… you don’t see the conversation so it is invalid as well. The fact still remains no matter how you slice it, some people cant do simple shit and it fucks everyone else over.
Also, here are things called prosthetics. His is mechanical. He can grip the wheel/handle bar and steer it just fine. He lost his left hand, so his right is still there to shift. On the bike, the throttle, clutch and front brake are all on the right. He is talented enough to clutch up a wheelie, blast past you. stop and take off his right prosthetic and hand it to you!
We can weed out “taking your eyes off the road” Via cell phone use being the causes of most accidents. It is all the brain capacity of the operator. Shit even the bank guy that comes to inspect my house has ONE EYE… wait he almost backed into my well pipe… lol I take that back. :ponder

Rarely does anyone send one text and be done with it. People have whole conversations via texts while driving (super retards). This requires READING of the text message. Try and figure out a way to do that safely while driving ;D. I don’t believe for a second that people can send a text of a least a few words without looking at the screen at least once while driving. AND even if it can be done, it takes up way too much concentration to do so, making you a risk on the road. Driving is a privilege, it deserves 100% of your attention.
How about we car pool for a week and I’ll text my heart out, drive with my knee, and otherwise do shit you say I can’t do because it’ll kill me and then you can do a research paper on your findings. I guarantee you we won’t get anywhere near causing an accident, and if we do get in an accident, it will be due to a person hitting us.
Fact of the matter is…you KNOW there are people out there who can do MANY things at the same time and still be 100% functional in doing all of them. You also know there are people who CAN’T do many things at the same time.

This law is another way for the government to make money. I’m sure there are a few deaths related to this, but not enough for them to make a law just for that reason. Isn’t it funny how these ‘interesting’ laws coincide with the shitty economy? They need to get money somewhere.

I agree with you on the fact that if you carry out an entire conversation VIA text messages… which imo is lame all to it self. But some people can click the right buttons to open a new text mesage, type it and click send. If it was something like “I will be late coming home, icey roads… see you at 6:00”. that doesnt really require a comment back to look at.
I also agree with you that driving is a privilege, they word it as such as a matter of fact, “Your driviing privileges have been suspended” I have that on paper. :ninja But i dont agree that is requires 100% attention to retain said privilege. I never said it was right or ok. I said it’s going to happen regardless because that is the world we live in today (technology, everyone always in a rush, etc.) and that not everyone should be getting punished for doing this because of a select few individuals who can’t handle doing it and driving. It happens. It will happen. Technology is everywhere around us. It is 2009 almost. Not all drivers who do this are bad drivers. Those that can still operate a vehicle safely while texting, changing the station, reading a map, etc. should not be getting punished for the select few people who can’t drive while doing those things (most likely, those people were bad drivers regardless).

it’s not as simple as that…they have to get paperwork filled out and faxed over to said cell-service company before they will release any records…usually that has to be filled out by the officer and signed by their commanding officer (sgt, lt) and may be a judge as well…

You get someone else to make some blanket statement comment and you instantly jump on board when if you were really to think about it… thats not what the fuck we are talking about. I come from a racing background. I have to use all my senses, at all times to stay in one fucking piece, and finish a race. I look a head, up down, left right. I have to have good periph vision, or I might get landed on, booted off the track, hit other people, hay bails, rocks, trees… My hearing has to be good. You have to hear who is behind you, how far they are behind you, are they gaining, or trailing, where in the racing lines are they. I also have to hear my bike, is it bogging, do I need to shift, is it about to blow up, am I running rich or lean, did I stall it… I have to have feel; are my tires breaking loose, are my tires low on air, is there mud, rocks, or sticks stuck in the bike, am I brakeing too hard, too soft. That is all just to stay in one piece, and not crash and finish the race. Now you have to take your eyes off your racing line, and look for people to pass. look at a pit board to see your times, think about who is ahead of you, how the points stand if you pass or get passed, who is behind you, will they run me off the track and hurt me or willthey race clean?
I am missing alot of stuff in there I am sure. But you get the idea. ALOT of that translates to driving on the road. The thing is honestly 65% of the people I see driving on the roads, would be like the people who cant even make it up the front straight on a MX track. When I get in my car, and drive in rush hour in NYC, with pot holes, cars, assholes in shit boxes that care about you… it is a cake walk compaired to racing.
I firmly believe that if more people took the effort to learn about their cars, learn simple physics, and get more in tune with their car, they will drive alot better. and maybe one day be safe enough to sneeze without accidently driving into oncomming traffic.

A bad driver is a bad driver. What is there to argue? Do you honestly think that them NOT texting will make them better if they are already a bad driver? I’m pretty sure some of the older generation doesn’t text…and yet they are pretty fucking bad at driving (some of them anyway).
