right, so technically it can be paid up to 11:59 tonight and not be late.

I have clauses for this in my leases the problem here is I inherited this tennant when I bought the house less than a year ago and her lease with the previous owner runs through the end of this year. When you buy a building and become the owner you are bound by the existing lease.

The other issue is that if anything ever goes to court in NY it’s really at the judge’s discretion as to what happens. A tennant can violate terms of a lease and if the judge sides with them your F’d as the landlord. Thats why is super critical to pick your tennants carefully.

NYS does not support landlords at all. We use to rent the house I now live in. We had a bunch of tools move in. Paid a security deposit and first months rent and we never saw another dime. It took a full year until we legally were able to evict them. We also got left with $20,000 in damages to the house. We have a judgement in court against them but in the 8 years since then we haven’t seen a penny. They no system and do this all the time. They did this to a previous landlord down the street. To a landlord not far from here after. They have it figured out they pay about two months rent and live there for a year free. I can’t even have a landline because of creditors for these scumbags here. I’ll never rent shit in NYS.

Once sure sign that the property is legally consider as abandoned is if they cut water and power off.
