Watch the documentary “Submission” by Theo Van Gogh…
1st degree murder can only be brought up if it was a contract kill or murder of a cop.
I’m no lawyer but this doesn’t seem right. Correct me if I’m wrong…
link to definition of murder first.
Legal Definition of Murder in New York and several other states
* Second Degree Murder: Any premeditated murder or felony murder that does not involve special circumstances. * First Degree Murder: Not only is the murder premeditated, but it also involves special circumstances, such as o murder of a police officer, judge, fireman or witness to a crime; o multiple murders; and o torture or especially heinous murders.
Note that under this legal system, a “regular” premeditated murder, without such special circumstances, is not a first-degree murder; nor are murders by poison or “lying in wait” per se first-degree murders.
[edit] Penalty for 1st vs. 2nd degree murder
A person committing first degree murder is usually put in prison for at least 25 years or more without parole, depending on the laws of the state whereas someone committing second degree murder might be imprisoned for 10-25 years with or without parole. There may be exceptions to this depending on age and state of mind of the murderer and the circumstances surrounding the crime. Some of these are described below.

i guess maybe they didnt think cutting someones head off was “especially heinous murder?”
Well I guess 2nd degree sounds about right, technically speaking.
I’m happy i’m not in politics or law.
and this is why nys sucks balls. kill him if u ask me. fucking scumbag deserves it anyways.
Hopefully it will be the life part, not the 25.
I just miss Johnny Chimpo in the afternoons on Bridges TV.
If he gets out in 25, I’ll bump this.
I disagree here. I know its going to cost us more money to keep this guy around, but I feel that most criminals would be getting the easy way out if they were given the death penalty.
They’re dead and it’s more money in “our” pocket. It’s easier for everyone.
I’d rather not have the potential for a man who very purposly beheads his wife to be released.
exactly I don’t care if it’s the easy way out for him, it’s the easy way out for us too.
Bullets are cheap.
But they wouldn’t use bullets. They would use chemicals/drugs to inject. You guys can feel that way about it, but I know there are reasons why they don’t do it.
I think Prison is probably more cruel, as BobbyG said, death is an easy way out. Reminds me of the one twilight zone episode
A mean-spirited, abusive hypochondriac sells his soul to the Devil (appearing as a rotund rogue who calls himself “Cadwallader” here, as he likes the way the name rolls off his tongue) in exchange for immortality, adding enough conditions to keep him out of Satan’s clutches forever. He is puzzled when the Evil One doesn’t put up much of a fight, only stipulating an escape clause which allows the man to die if he so wishes, but doesn’t worry too much about it.
He uses his newfound invulnerability to collect insurance money and cheap thrills by hurling himself into life-threatening accidents. Soon growing bored with this game, he confesses to the murder of his wife (who actually accidentally fell off the roof of their apartment building trying to stop him from jumping), hoping to experience the electric chair. His lawyer is too good, however, and he is sentenced to life in prison without any chance of parole. In the last scene, the Devil shows up and reminds the man of the escape clause. Realizing he will face eternity in prison if he doesn’t use it, the man nods and suffers a fatal heart attack. The guard discovers his lifeless body and sighs, “Poor devil…”
They could always just behead him in the same manner.
how is death the easy way out? It’s too easy to get out of jail with good behavior. Some state governments are so strapped for cash that they’re considering early releases for prisoners to save money. This happens a lot in Los Angeles. No space and no money.
If you put someone in jail for life with no parole, you are basically killing that person anyway. They will rot in their cell and never again be a contributor to society. It’s more of a drain on taxpayers than it is a lesson.
Make this fucker rot in jail cell, get beat by inmates, be used as a personal fuck doll by 95% of inmates and never see daylight again. The chances of his getting out will be very slim if he keeps up his ways like he did during the trial.
This. From what I’ve heard the bike path rapist got the shit beaten out of him like the first week he was there. I’m all for cruel punishment for people who commit serious crimes, especially against children. I think the “lethal injection” is too easy for prisoners. I think serious offenders should be anally raped by a horse.
