DoJ no longer defending Defense of Marriage Act

The Defense of Marriage Act was passed in the 1990’s creating a federal ban of gay marriage. Yeah it’s laughable that congress thinks it has the power to regulate marriage (maybe via the interstate commerce clause since married people buy things :picard: )and disgusting that it was never struck down by the supreme court (not that they’ve defended the constitution since FDR), but that’s not why I made the thread.

The Obama administration has ordered the Department of Justice to no longer defend this law. Now how does that work? I’m all for it not being a law, but it is a law. How does the DoJ just get to pick what laws to enforce?

They said it was indefensible.

It doesn’t. This is just a political move & distraction. If he wants to alienate the 80% of black Americans who believe in traditional marriage over earning favor with the LGBT community, let him.
