DUI Checkpoint Flyer

I have nothing to add here except that DHS video made me giggle at times. Thank you for that.

I often have vehicles that are not inspected. There is no valid excuse for not having a current inspection on all 6 cars other than me being lazy. I use to get stopped all the time in my turbo SHO and for anyone that knew the car it was extremely loud and cor a while did not have a front bumper although it did have a plate. I would always cringe and wonder if i had a plate light out or something stupid, or worry about getting a exhaust ticket. It did only have 3 foot of pipe after the turbo so it would have been deserved but if not for the check point i would have never worried about getti g a ticket in that car.

I hate everything about checkpoints. Same logic goes for cops shooting radar on 290. Stop collecting speeding tax and just drive around on 290 at 55mph. You will actually SLOW DOWN traffic rather than putti g yourself and the person you pulled at risk of being rearended.

having personally worked a BP checkpoint, these checkpoints are AMAZING at catching narcotics and illegal aliens…
and legally, every car HAS to stop at the checkpoint, but you DO NOT have to speak or answer to an agent.

I’m on both sides, I see the pros of these checkpoints; at one checkpoint alone in Texas, the seized 40 TONS of narcotics in one year, all shit coming from Mexico, and, arrested 28,000 illegal aliens… that’s 28000 less people in this country who are not legally allowed here.

Now, as a US citizen you should have the reasonable expectation to travel freely throughout the country… the difference is this, you don’t have the RIGHT to drive, you have the privilege…

Do I agree with checkpoints… not really, but theres other things in this county that I disagree with A hell of a lot more than stopping for 5 seconds at a checkpoint…

So how do you have the reasonable expectation to travel the country, on foot? Certainly not by air. Also, how much of that 40 tons was weed? Glad to see it helped the country’s drug problem, another war on drugs success story.

Ignoring the arrest of 28,000 illegal aliens because it’s easier to focus on the drugs? 40 tons is a HUGE number, marijuana is measured dry. I would guess that not 100% of the drugs recovered were marijuana as well.

The illegals is impressive, some of those guys floating down by the border are bad people to say the least.

The funny part is last time I went through the border patrol checkpoints on I-10/I-8, I was with a Canadian chick who I later found out had visa issues. But she was white and blonde so no issues to report :tup:

Just an FYI Canadian and Mexicans have very different entry/exit “visa” requirements and it is certainly not something that a checkpoint would catch unless it was a blatant overstay situation.

im not going to get into it a ton but here is just a brief overview of why that happened and not just because she was white and blonde.

Canadians do NOT require a b1/b2 visa but instead only need a passport that is valid at the time of entry and they can be in the US for up to 6 months at a time. But they are NOT allowed to live permanently or work here in the US. Think snowbirds.
Does it happen? Sure. there are TONS of Canadian citizens living illegally in our country. Are they ever caught? Of course but typically when crossing a physical border when agents have access to other databases.

Whereas Mexican citizens require a b1/b2 visa of some sort (border crossing card or physical visa in passport) and are given a travel document and stamp showing the entry into the United States. This makes spotting a Mexican overstay situation easy to do within the 5-10 seconds a typical checkpoint stop takes.

The fact of the matter is, immigration checkpoints are all about low hanging fruit…

is it easy to let through an anglo european here with a prper passport/visa…but also has over stayed their visit? Yeah… because a lot of times, to keep traffic flowing, cars will just be waived through unless a dog hits on a vehicle indicating hidden passengers.

Yes, majority of that is weed, but also a lot of methamphetamines cross the border, as well as cocaine (as the gulf route is quite dangerous) and heroin. Don’t agree that weed is a drug? okay, i see your point…but also, if weed is grown in the United States and harvested by US workers, taxes paid yada yada…i see no problem… but this weed from Mexico is being imported with no duties paid, not taxed etc. Another thing, these checkpoints near the southern border not only catch just illegal aliens, and narcotics, but they have broken up HUGE sex trafficking rings. You know, girls from central america, being brought to the US by a smuggler for free, well, except that they have to give up their bodies for 10 years to repay their debts for being smuggled.

I’m not sitting here and arguing that checkpoints are a slippery slope… although FEDERAL IMMIGRATION checkpoints are actually 100% Legal… thanks to a ruling by the supreme court in the 70’s. Think of these checkpoints as a “safety” position in football. If you were a defensive coordinator, you woulnd’t line the entire defense up on the line of scrimmage every time, woukd you?

NOW: internal DUI checkpoints (state run) are a VERY different story, in my state (WA) checkpoints are ILLEGAL. NY has some of the most frequent checkpoints in the entire Union… another reason to maybe leave NY?

Ending: if you guys have any other questions, let me know, I can answer to the best of my ability, and may have a bit more knowledge than your average NYspeeder as to your rights, and the legally of said checkpoints.

To expand on what Walker said, people/ travelers crossing into the United States don’t realize officers at the border have much more authority at the immediate border for searches than most other law enforcement.

My point was other things apply like as a US citizen you could still retain a lawyer during questioning coming into the US.

well, yes, and other rights as well, like being able to vote, etc. but since this thread was about 4th amendment rights, that’s what I was focusing on.

And I really hope you’re not referring to me, as, I’m sure I know, and respect the constitution much more than you… I believe my point to this thread is giving legal information, not attempting to scare people into the new world orders

What you meant to say was you give up portions of your 4th amendment rights crossing the boarder like needing reasonable suspicion to search vehicle however something like a strip search would still require reasonable suspicion…You would also be able to retain your 5th amendment rights to have a lawyer present during questioning if it was outside of standard questioning relating to travels.

is it safe to say DHS employees in this video are also experts on the constitution?
