Your employees may be under the influence of weed right now. Just because it’s illegal doesn’t mean it’s not around.
I believe his point is;
If it becomes legal and an employee is injured and/or damages equipment on the job most of the “common” testing only tests for metabolized THC.
In one case the employee could be under the influence, but the employee could claim “No, your test only proves that I smoked within the last 45 days”.
-or-
The employee could be law abiding and 100% sober at the time of the incident, but still “have it in their system”.

If I test someone now I can fire them. Will I be able to fire someone once it is legal and they have it in their system?
Honestly this is the only problem I have with legalizing it. Owning a business such as mine, this could be a big issue.
I see. Would you fire an employee for having it in your system even if they were doing a great job? I used to pay a mechanic friend of mine in the green stuff to do work for me back in HS. The attention to detail was always spectacular.
I have some people who do a good job… When they show up.
I forget the precise number but something like 80% of attendance problems are drug users.
