Federal Safety Officials debating lowering DUI % from .08 down to .05

So she was drunk, high on pot AND high on cocaine?

AND THEN drove?

Winner.

Why would you do pot and cocaine at the same time? Seems counter productive. Much less booze too, and drive.

Yeah, don’t forget other drugs combined with alcohol playing into those stats. Someone may have a .05 BAC but they also just took a cocktail of pills that would cause any normal person to pass out.

IDK if I agree with that sentence… I’ve seen WAY worse INTENTIONAL crimes go either unpunished, or for a lot less time.

Should she do 15 years for this crime? SURE; as long as every murderer gets 30+ years.

Sorry if I seem bitter, it’s just…our justice system… eh.

That dude who drove the wrong way up the 33 and killed people only got a couple years…

This is what really pisses me off about our justice system. Its a joke, its all about how much negative attention the case get via the media. Its a f***in joke.

FYI the average time served for RAPE is less then 5.5 years.

Are we talking legitimate rape?

Instead of fixing our legal system we just make more laws to counter act the failing system. Who does this benefit? I will give you a hint: most law makers are attorneys. See the connection?

I haven’t seen anything in this case that said she took them at the same time, or was directly under the influence of those drugs. Only that it was found in her system.

So one scenario is that she smoked within the last 45 days, and snorted within the last 3 days and woke up with a really bad hangover on the day of the incident.

Another scenario is that she was smoking and drinking all night, and took a bump to get started in the morning to go to work.

Remember, that Alex Rice also had MJ in her system, but whether it was a contributing factor in her decision making can not be determined.

Without law officials releasing specific values of the substance found, what those levels mean to an average person, and whether or not those levels directly affect decision making will only create speculation.

She had a prior DWAI. Which helps explain why she got the max.

You mean other than the defendant admitting she’d been drinking and smoking just before the accident?

Kellogg admitted to authorities that she drank several beers, smoked marijuana and had been falling asleep prior to the crash

Well, doesn’t change my opinion of her.

She’s still a loser.

That is correct, before you posting that link I had not seen that information.

What was the quantity that she smoked? What were the values of the THC and the testing method used by authorities? How do those levels affect a normal person?

I’m not disputing whether or not that she sucks at life. I’m am just curious. I think we all can relate that 4 beers in an hour = about .08 . However, “found in her system” does not have a tangible or relative value.

This is the main reason weed needs to stay illegal. I can easily measure if an employee is under the influence of alcohol but weed is another story. Sure they may have it in their system but proving they are high may be a challenge.

And the Amherst doctor who did 1 year for killing a girl and trying to cover it up.

Her blood alcohol level was .13. The other levels are fairly irrelevant from a prosecutorial standpoint. Her BAC was enough. It’s just used as further evidence that she does in fact “suck at life”, and was under the influence of at least 2 substances at the time of the crash, and uses another illegal substance on top of that. It speaks to a pattern of illicit behavior, especially for someone that’s already had a DWAI, and why she would deserve the max.

I don’t really get your complaint. I think the prosecutor did a good job on this one (though I’m admittedly biased on this).

I’m pretty sure that while my friends had a townhouse at Hilbert many years ago, this girl came to one of, if not a few of the parties they hosted. I recognize her and if it is, her and her friends never really grew out of that party phase.

Not complaining…
