How many times do we have to say this.
Because there aren’t those customs stations to collect duty on your “out of country” purchases, and because the Senecas refuse to collect the sales tax for us when non-residents purchase their goods, NY is going to collect the tax at the wholesale level.
And yes, they should be doing the same for gas as well.
I think they should tax dumb people more. Everyone below a set IQ has to pay xxx more.

sigh I guess my point is that they shouldn’t be subject to anything under the STATE level, federal is a different story. The state is over stepping it’s bounds by forcing anything upon them. I didn’t mention anything about canada (if anything, it’s more in line with washington DC’s relationship to maryland than canadas relationship to the US) and I do agree that maybe the state does do a little too much for them.
If they want to send their children to public school, fine… let them pay county school taxes or setup their own private system.
As for the road thing (plows, marshall patrols, etc), I believe (correct me if I’m wrong) that it’s probably the states/feds responsibility since the senecas give US residents free use of their roadways as marked in the treaty. Obvously, not much (if any) of these were issues in the 1790’s when it was signed so there are a lot of grey areas that aren’t spelled out.
again, I’m not saying that non-indians shouldn’t be paying taxes, but it’s not the right of the state to force them to collect those taxes, nor is it their right to tax them (the indians) at a wholesale level… nor can the state accurately enforce it by themselves by hoping that everyone is honest about it. Looking back, my previous examples are pretty bad attempts at connecting those dots, but whatever.
It’s NO DIFFERENT than Newegg and Amazon telling NY to go fuck themselves when NY demanded that they collect sales tax on purchases from NY residents.
I don’t buy my cigarettes or gas on the reservations, so it’s not so much that as it just bothers me to NO END to see the state keep dipping it’s greasy hands into our pockets. You give them an inch and they’ll take a mile…

doesnt matter… you still legally have to pay NY state tax on it, regardless of where it’s located, since you’re buying it IN New York.
youre supposed to do that on your tax return. they have a box for internet purchases you didnt pay tax on

No, because there is established case law saying you don’t have to pay sales tax on internet purchases if the retailer does not have a presence in your state. NY tried to get around this case law by greatly expanding the definition of business partner to include anyone who has done advertising for a merchant. It’s illegal, and will be overturned.
As for the cigarettes, there was a supreme court ruling back when this first came up that taxing non-native purchases was allowed. It gets referenced all the time in the news but I’ve been unable to find the actual supreme court case they mention. Assuming it does exist, which I would hope it does since multiple news stations have mentioned it and the Senecas haven’t called it’s existence into question, the newegg thing is exactly the opposite.
