So if I buy a car from a used car dealership Florida on ebay, do I not have to pay NY taxes on it? (serious question btw)
in reality you don’t unless you plan to register it in NY. in theory you do since you live in NYS
yeah, that was actually a bad example. cars are usually treated differently than most goods (have to register it I guess… and that aint happening without paying taxes)
agreed, they are in NY state. It doesn’t mean they’re required to comply with nys laws on their own territory (much like DC doesn’t follow marylands). I don’t know the in’s and out’s of that though… and trying to find specific information about reservation tax laws and laws general is like pulling teeth. I do know that they’re subject to federal law though
I’d have a hard time believing that indians don’t have to comply with state DWI laws, on their land or not
If you register it in NYS, yes. I bought a truck in NC, paid NC tax, then when I moved back here 3 years later, they still wanted me to pay tax on it, even though it was registered, in my name, in NC. This is the killer, they wanted me to pay FULL NY tax, on top of the 3 percent paid in NC. Now I was military, so its not like I was getting around by driving down there on a weekend.
I called and bitched to the tax department, they said that I could call NC and tell them I am registering it in NYS and ask for my taxes back. I asked the dumb bitch if if NYS would do this if I had moved to NC. “well of course we wouldn’t” was her reply. FUCK NYS.
so? did you end up paying tax?
not surprising in the least bit.

a pretty interesting read
Good find man.
That litigation was finally resolved in 1994, when the United States Supreme Court held that the State’s regulations were not preempted by the Federal Indian Trader Statutes ( Department of Taxation and Finance of New York v Milhelm Attea & Bros., 512 US 61; see, 25 USC § 261 et seq.). Having concluded that “Indian traders are not wholly immune from state regulation that is reasonably necessary to the assessment or collection of lawful state taxes,” the Court reasoned that New York’s system of collecting taxes “early in the distribution stream” and imposing a quota on untaxed goods available for sale to reservation members was an acceptable method of preventing tax evasion ( id., at 75).
Finally, the actual US Supreme Court case.
my mother told me last night the price of smokes on the res doubled very recently. I seem to think she’s out of her mind. I haven’t heard anyone complaining about it like you would assume, and there’s no tires burning.
can anyone confirm wether the price was raised or not?
i posted earlier in this thread about it.
Smoking joe full flavor went from 1050 to 1550 overnight a while ago.
My pops was pissed off.
hmm, i paid $28.xx a few weeks ago for marbs, and she said they’re somewhere around $42 now. hope this isn’t true.
but then again, would give me another great reason to finally quit.
your dad smokes full flavor smokin joes’ and he’s still alive? impressive.
Read that a judge ordered NY to cease trying to collect tax on them… so if they’re going up, I don’t think it’s from tax
IF EVERYONE WHO SMOKES, QUIT…
our other taxes would skyrocket.
so keep smoking everyone that does! you are keeping my already outrageous taxes lower than they would be.
I personally think its retarded, cig smokers are the worse addicts and dont even realize it. fiends man, fiends.
word…coming from a smoker who knows it, lol.
Your statement applies only to people that have health insurance. If Medicaid people would lay off the Newports I’d have to pay less for their emphysema and tracheotomies.
bump
saw them talking about this issue on the news again.
I called it, how long before the tolls go up and we need to pay to use the highway on their land. how long before we cant even use the highway there?
i gte a kick out of people who will literally walk out of an emergency room, sign themselves out AMA (against medical advice) in the dead of winter because they have to have a smoke. These are people with chest pain, short of breath, broken hands, you name it. unreal… tell me its not a drug.
Fun times ahead
