But I just noticed that I may have a problem?

The first top line shows the unit(unknown) that I have…
The second bottom line shows the hose that I have, now the thing I see wrong is that my hose is cut off about 1" from the unit and goes nowhere, just open on the end…Note: This is not my engine-bay, just an example…

it will not affect if your engine pass’s or not
but if they are assholes they might say something about it but i doubt they will

Hard to tell from the pic. But the unit is the AIV (i think). The hose that comes out of it goes to the stock airbox. In this car, the airbox was removed and replaced with that cone filter.

Yes, that is the AIV system. (Air Induction Valve).
It lets air into the exhaust at certain moments to help in the warming of the cat.
Make sure to drive your car for atleast 15 mins before the test to make sure it is hot.
The AIV is an emissions device, but only opens at certain times. I passed without mine, as well as without the EGR. Although I had a new O2 sensor.
You don’t need it to pass. period.
