S&R had Law Man on over the summer, he made it very clear that this shit just doesn’t work anymore, this isn’t 1970. You’re guilty until proven innocent and that is all there is to it. This was around the time that Dr hit and killed that girl (mentioned earlier in this thread). Several scenarios were discussed and all of them led to jail time.

You honestly think that going to a bar after the accident will get you anywhere but jail on DUI charges?

Legal advice is best received from a lawyer/judge and not NYSpeed… I think we’ve been through this 1000 times. I’m not saying for anyone to listen to me, but for god’s sake… don’t listen to anyone on here. It is all in what lawyer you can afford and how well they know the judge.

The police can def prove beyond a reasonable doubt that someone was drunk when they crashed their car, even if they just came upon an abandoned car in a ditch, they don’t find the driver till the next morning or even after the fact far away from the accident a few hours later. Def makes tons of sense

Obv your best bet if you put your car in a ditch while intoxicated is to call the police on yourself and wait for them to come and arrest you. It’s a no brainer!

Seriously though, I have a friend who rolled his car in Eden while drunk, he hid in a barn for 2 hours until he could find someone to pick him up. Went home, went to bed. Woke up at 7 am to the police knocking on his door, went down to the station and didn’t say a thing incriminating. Blew a .03 the morning after. Got a leaving the scene of the accident ticket, went to court, paid a $100 fine and that was that.

Thanks for reinforcing what I’ve felt along. Good thing they fixed that loophole when you kill someone, not every accident ends in death. Some things are actually worse.

Exactly^ if someone is shitfaced hammered and swerving all over the road, they deserve a dwi. If you have had a few, are driving home in snowy weather and go off the road, your best bet is to bounce

well i would just say that i have had one…and it was really just wrong place wrong time…turned down an alley about 500ft from my apartment and there just happened to be a cop right there looking to pull people over for whatever reason…probably looking for heroin runners, but they got me instead. ended up going to jail and had to go through a ton of BS. i’ll never drink and drive again just to avoid the shit, but there are tons of people who could get caught for the same thing and just don’t…

The “best bet” would be to behave like a responsible human being in the first place so you don’t have to worry about legal loopholes, property damage and potentially killing innocent people.

The 2nd comment…at least you don’t discount all drunk driving. But if you’re impaired you really shouldn’t be driving period. It’s not worth the financial risk and above all that it’s not worth putting other people at risk.

Life is about balance, here we are balancing risk & reward. The potential reward for driving drunk is not having to call someone for a ride or pay for a taxi. The potential risk is MUCH greater than the $20 cab fare or inconvenience. Seems like an easy choice to me, even setting the putting others at risk piece.
