Our tort system is not perfect, but when you come up with a better way to make a person or family “whole” again after losing a loved one or a catastrophic injury, let me know.

There’s a big difference between losing a loved one, etc due to blatant negligence vs an accident.
The definition of accident: an undesirable or unfortunate happening that occurs unintentionally

Baseball is a potentially dangerous sport. I can guarantee that batter didn’t step up to the plate with the intention of killing the pitcher by hitting him with the ball. It was an accident.Accidents happen, life isn’t fair, its time people (ie: lawyers/judges with no backbone or morals) realize this. In no way should Louisville be responsible for an accidental death when there are probably 20 million other bats out there that have never injured anyone.

She suffered 3rd degree burns on her legs which required skin graffs.
She sought only $20k for medical, Mcdonalds only offered $800.
When McDonalds refused to raise the offer she got a layer and sued for gross negligance and ALOT more money.
I agree alot of lawsuits are frivolous and I want judges to have the power to impose legal/court fees on the plaintiff if frivolous. But Avatar is right on this one.

I’m boiling water on my stove and take the pot off to pour myself some hot water to make tea with. My dog runs into my leg while I’m pouring the boiling water, I spill it on myself causing burns. I’m suing Pet Smart for selling me the dog, Purina for making the dog food that’s kept my dog alive (had he been dead he wouldn’t have run into me…), Kenmore for brand labeling the stove that boiled the water and finally Maytag for actually building the stove that boiled the water.
Sounds fair… William Mattar wouldn’t take my case because I wasn’t hurt in a car. Thankfully Celino and Barnes did though!

Not to mention McDonalds served their coffee 30 degrees hotter than anyone else, causing 3rd degree burns in 3 seconds. If they had served it at the normal temp, she’d have had something like a minute.

Intention has nothing to do with negligence. If you’re really interested look into product liability including strict liability and the requirements for a prima facie case. Also, if we remove this mechanism for justice altogether, society will suffer for it.
