Motorcyclist wins taping case against state police
A Harford County Circuit Court judge ruled this afternoon that a motorcyclist who was arrested for videotaping his traffic stop by a Maryland State Trooper was within his rights to record the confrontation.
Judge Emory A Pitt Jr. tossed all the charges filed against Anthony Graber, leaving only speeding and other traffic violations, and most likely sparing him a trial that had been scheduled for Oct. 12. The judge ruled that Maryland’s wire tap law allows recording of both voice and sound in areas where privacy cannot be expected. He ruled that a police officer on a traffic stop has no expectation of privacy.
“Those of us who are public officials and are entrusted with the power of the state are ultimately accountable to the public,” the judge wrote. “When we exercise that power in public fora, we should not expect our actions to be shielded from public observation.”
wtf, no lights, no uniform, no badge, NO initial indication stating that he was a police officer the SECOND he jumped out of the car ARMED, Im glad this dude won, but she shoulda won more then he did, I would have either punched the shit out of my throttle or dumped my bike and started defending my life.

4/7/2010: 6 Cops show up at my house with a search and seizure warrant for all of my computers, cameras and electronics… They also bring an arrest warrant for “wiretapping” and 2 additional traffic violations. I could not go to jail due to health issues (surgery).
4/14/2010: I turned myself in and spent the night in jail. I was charged with “wiretapping.” Felony- 5years $10k max fine. Bail set at $15k?
4/15/2010: Bail review - Released on my own recognizance.

it looks like he jumped off the highway, and got to a light at the off ramp, where that unmarked was flying behind him following him… he looked over his shoulder and prolly thought who the fuck is this guy. then he stopped at the light and he came up behind him and you got out. the trooper was right behind the unmarked/CIVILIAN car.
How can an off duty in his own car essentially pull over at gun point someone???
I got “pulled over” by an off duty in his personal truck, he fliped the fuck out on me as he aproached my truck… I had it in gear and ready to dump the clutch and one hand on a tire iron becasue I had know idea who the fuck this guy was. he said he was a cop and he could arrest me and shit right there, I said fuck off you physco, and i left the joint. found out after the fact who it was and he was a amsterdam cop, who is a loooose cannon.
A NYS Trooper Negroid did something similar to me. He almost hit me as he cut in front of me, so I flipped him off. He hammered on his brakes full force (on the northway) and then put his hat on. I told him to fuck off and that he almost hit me to which he told me that never happened. He tried telling me he was going to write me a ticket, which he couldn’t do as I didn’t do anything wrong and he was off-duty.
Krazy, what was the cops name. Just wondered who it was. I try never to do anything to the point that I usually don’t get pulled over. But having an off-duty cop in his own personal car try to pull you over and lay some law. Yeah, I’d be pretty unhappy with that. And how do you even know they are a cop or some random psycho wantabee. I’d wonder where that point is too, you fight for your life because you don’t know what’s going to happen or run, or what.
I talked to some Hegaman fire bud’s, discribed the short inbred looking fucker and the truck… the LOL’d and said yeah that would be Pruski, he has been written up for that shit many times.

Hmm, a Pruski. I was a friend with a Pruski in HS. Seriously doubt he became a cop though. I thought his mom was a Sherriff though, or something like that. Yeah, def. scary. I mean, some guy tried to pull in front of me with a regular vehicle, jumped out and pulled a gun. I can say, it’d probably not end well. How do you know they are a cop on a rant or some crazy lunetic with a gun. What do they think they are doing. Especially if they are in their personal car with no lights. Another thing, NYS is a concealed carry state for carring a pistol. Unless you are showing a badge. As far as I’ve been told. Man, sorry it happened to you. My first thought would be to jet out of there too.
I believe city/village municipalities can pull you over in a undercover car. But I think undercover car still has to have lights on it. A cops personal vehicle should never have that, that I know of. Agian, all stuff I wish I knew. Wish I knew the letter of the law.
And go and make a complaint. See how many cops follow you everyday to work. You’d have your own escort, that’s for sure. Waiting for you to mess up.
