Movie Theater that told black folk to be quiet and turn off cell phones vindicated.

The Delaware Supreme Court overturned a decision by the state Human Relations Commission that the manager of a Dover cinema was racist when he used a “condescending tone” in telling a crowd of largely black patrons viewing a Tyler Perry movie to silence their cell phones and remain quiet.The commission also ordered the Carmike 14 Theater to pay nearly $80,000 for violating the Delaware Equal Accommodations Law after it determined the October 2007 announcement – which was not regularly made in that way in other theaters – “insulted, humiliated and demeaned” patrons in that manager David Stewart had singled out a black audience at a “minority-themed” movie.
Court papers note that extra security also was brought in that night and guards were double-checking ticket stubs as audience members entered, which the plaintiffs said further added to the humiliation.
The Supreme Court, however, tossed out that finding and the fine late last week, ruling there was no racist language in the announcement, no specific group was singled out and the non-racial explanation for the announcement – that it was part of a since-discontinued company policy at sold-out shows to ensure that all patrons would enjoy the movie – was reasonable.
The court also noted that the then-director of the state Office of Human Relations was in the crowd that night, announced to the theater that she was offended and organized patrons to file the complaint with the Human Relations Commission.
The incident happened Oct. 12, 2007, at the sold-out 7:15 p.m. showing of the movie “Why Did I Get Married?” where the cinema was showing the picture in three theaters simultaneously.
The warning about cell phones was shown on the screen and then was delivered in person in the largest of the three auditoriums by Stewart, according to court papers. Some patrons later said Stewart’s tone “was offensive and condescending, as if he were speaking to children.” And because the crowd, which had been well-behaved to that point, was “90 to 95 percent” black, some felt it was racist because it implied that blacks did not know how to behave in a movie theater.

Someone really needs to suggest they get organized and start boycotting movie theaters. It would make it a lot better for the rest of us. :wink:

Lol, I thought all of this was common knowledge? Chances are the supreme court justice has been to a movie or two and can relate to the distractions that certain persons bring to the theatre.

The only time “Tyler Perry” and “Best” should be used in the same sentence is when you’d say “Isn’t it the best that Tyler Perry is dead?”

I saw the racism at the elmwood regal when it came out. I had to leave because a bunch of people were yelling and acting obnoxious during it. Then they all jumped eachother after the movie and the cops had to come. Ruined my night.

I’m pretty sure an NAACP member could come out of the Elmwood Regal with racist feelings. I used to rent an apartment close by and would just drive out to the burbs when I wanted to see a movie.

There was a “gang” fight on Christmas at the Regal Galleria. The “gang” lines were drawn by their bus # and route. They were yelling them out in the theater. :ham:

regal in orchard park seems to be the only one you can go to and actually be able to watch a movie still. If a group of kids start getting loud, a stern (not rude) “hey, quiet down” usually shuts them up, and you won’t even be called racist for asking

If you sue and lose, you should have to pay, this will keep BS lawsuits and filings to a minimum.

dude i went to see snakes on a plane at elmwood regal a while ago… this one woman kept yelling “YOU GET EM SAMMY” “THATS MY MAN” ect, ect

There was a guy behind me and my fiance when Transformers 2 came out that wouldnt shut the eff up. I asked him nicely to please be quiet and he said to me “What, i cant enjoy the movie.” He was quiet for a while and then started up again. I got up and sat next to him. He didnt say a word the rest of the movie.
