Actually, in NY, you can file a “fault” divorce… due to adultery, although you do need proof from a 3rd party.

edit: also, if this guy can prove that his wife is physically/mentally abusing him, he may have a case as well.
{getting in his way while he’s trying to be civil and move out (false imprisonment) blowing smoke in his face… verbal abuse etc etc.}

Correct, there are 6 causes plus “no fault”

but even if you divorce “for cause” that doesn’t result in giving up property rights under equitable distribution.

Yeah he’s not doing anything else. He just wants it over with. Already gave her the house. He gets to keep his pension though. That was the big thing that she was originally going after.

Hopefully in in a few more weeks he’ll never have to see her ever again.

(He didn’t give her a 100% paid off house, he’s just forgoing his share of equity in it. Moving forward, it’s her house now).
