Yep, Cliff is right, unless something catastrophic failed in the car causing the accident then its the drivers fault, end of story.

Unless a deer jumped in front of you and you hit it? But that is probably debatable…

And if something failed on the car it’s the owners fault for negligence and lack of maintenance.
