what if someone is very stupid, or maybe instead they are handicapped, and cant afford a lawyer to help them. they can’t be appointed one because they arent being charged with a crime. what do they do.
great, now I regret ever getting involved in this discussion since it was all based on what was said on some completely biased, one-sided, government hating site.
They seize it and make it a pain in the ass to get it back (come to station, sign forms, etc).
Laws are intentionally written vaguely for the reason that every step in the justice system (police, lawyers, judges, etc) can interpret it differently and use the ambiguity to achieve the result they want.
