What is the legal admissibility of audio recordings?

note - this is not me for those wondering, I live in UT (therefore NYS laws aren’t applicable).

I fucking hate you so much right now.

This is illegal in ANY state based on the situation. You can not record any audio you are not present for no matter where it is. If you were there or someone with written consent who had the recorder for you then you are OK since you have one party in NY but outside of that, this is illegal. /thread

Talk to a lawyer, not NYspeed.

Just put a camera in the house and edit the video with your audio so it seems like it was a recorded video rather than just audio.

LOL

Yes create some evidence

fuck the lawyer, why not go fuck another broad or 3, in her face. and be like bitch. THATS how you cheat.
and let her call it off…

in any case this is why ALL modern marriages SHOULD have prenups.

ORRRR better yet bust “Cheaters” on her… or style!

Go out another weekend, except rlly steak the place out… than BUST IN with cameras!!! and shit!!! And post it on the internet!!!

HUMILIATION!!!

That is brilliant. I love it.

Answers I get back from nyspeed members have shaped my life. I never question the validity of anyone’s knowledge on here. Why would you?

This is illegal on two accounts. You can record people in your house at will but you can not take audio. ILLEGAL

Edit video and audio to make your case and be untrue. Also ILLEGAL

I talked with him about a few things. But, he seems to be protecting her. Granted, lots of variables. But, there are ways to get this taken care of. I think he is just paranoid.

Tell the Mrs. to sick Terry on her…Record. Profit.

I never had an issue with her but this is just sickening…

Poor Bastard.

What? Did I miss some details in this thread?

Terry involvement in the situation, LMFAO! If we’re going to go that far, just have the warehouse and let the entire group of degenerate band members/groupies/hang-arounds at her, I’m sure they’d have fun.

Agreed, lots of variables, namely the 2 kids… that’s who I feel the worst for, honestly.

lol… great plan. Go into civil court and admit on the record to a class E felony (that’s what he’s guilty of based on the limited info provided in NYS).

Some good reading for anyone who is considering doing this kind of stuff.

In all seriousness, this sounds far too serious to be taking any advice from an internet message board. Knowing what a few laws say on a DoJ website and having watched 12 angry men or even taken a law class is a far cry from knowing how to properly handle a situation that sounds like it could very well end in criminal prosecution or divorce proceedings or the like.

However, if this is just a bunch of cheating drama between an unmarried couple with no significant joint assets then stop playing Matlock.

I can’t help but think of that comedian…

“A good friend will help you move, a great friend will help you move a body.”

Married, 2 kids (1 & 3), newly remodeled house, etc…

So your friend with two kids caught his wife getting boned via secret tape recorder. He needs to decide whether he wants to talk to a marriage counselor or a divorce lawyer, and he should probably tell you to stop gossiping on a local car forum under the guise of asking for advice from the absolutely wrong place.

Ya’ll are worse than a bunch of women. I’m out.

Oh that talk has been had. I was just wondering about the tape recording thing, that’s all. Thus the limited info that I gave out to start with.

LZ gave me the answer that I was looking for right off the bat.

I’m pretty fucking good at using google
