WEST PALM BEACH — None of the people chatting amongst themselves during a court break seemed to notice the tears falling down Andrew Rutman’s cheeks. A few drops snagged in his full, white beard as he sat alone, quiet, still.

He watched 28-year-old Kenneth Richard Jenkins hug his friends and family goodbye, knowing he was headed to prison for getting drunk and causing the March 2008 wrong-way crash that killed three people, including Rutman’s 83-year-old father Robert.

Rutman felt a flood of emotions, he said. He missed his dad. He felt a twinge of sympathy for Jenkins.

And then he remembered the video footage he’d seen of Jenkins playing beer pong at a local bar just three weeks ago, footage prosecutor Ellen Roberts played for Circuit Judge Richard Oftedal during Jenkins’ sentencing hearing Friday to argue he lacked remorse.

“He gets to go around and say goodbye. We never got to do that,” Rutman said of Jenkins. “You know, you feel bad because he’s young and no sentence will bring my father back, but look at the damage he’s caused.”

Moments later, Oftedal came back into the courtroom and told Jenkins the damage warranted a 33-year prison sentence.

Jenkins’ attorneys had hoped for a four to eight-year sentence, banking on the fact that Jenkins had no prior criminal record and planning to come into the sentencing Friday with a strong case showing Jenkins truly sorry for causing the series of wrecks along Interstate 95.

But they learned Wednesday of the beer pong video, captured by private investigators Andrew Rutman’s cousin Howard Handler hired after the cousins heard from one of Jenkins’ friends that he was still drinking and partying after the deaths.

“I was overwhelmed,” Jenkins’ attorney Lee Goldberger said about the video. “My reaction was to ask why? But after we talked about it, I understood.”

Jenkins told Oftedahl Friday that the drinking incident was a one-time event for which he wasn’t proud, but he did it because he was scared at the prospect of going to prison.

State troopers arrested Jenkins shortly after the March 2008 morning he drove his black Pontiac GTO south on northbound Interstate 95, causing a series of crashes, including one in which a Delray Beach police officer broke his ankle.

He eventually collided with a white 2000 Mercedes sedan, instantly killing the driver, Barry Rapoport, 54, of Hampstead, Quebec; his mother, Renee Rapoport, 78, of Westmount, Quebec; and Robert Rutman, who was Renee’s boyfriend. Barry Rapoport’s wife, Angela Pagliuca Rapoport, was injured but survived.

She and several other relatives spoke at Friday’s sentencing, which lasted all afternoon.

Others spoke on behalf of Jenkins, calling him a kind-hearted person who helped others and would have never intentionally caused someone’s death.

Jenkins himself apologized to the families. “In an instant, I wiped away whatever good I have ever done,” he said of the crash.

But Roberts told Oftedal that had Jenkins been truly remorseful, he would not have continued drinking. Oftedal cited the video footage of Jenkins drinking as signs he didn’t deserve a lighter sentence.

“I think the video was a slap in the face and an affront to the victims’ families,” Oftedal said.

For Rutman, who said he was satisfied with the sentence, the video will fade into the background as he tries to replace it with memories of his father, a man with whom he had been estranged but only recently reconciled before his death.

“He had a good life, 83 years,” he said. “It’s sad that this young man won’t get to do the same.”

pretty pathetic on his part… If three people died as a result of my direct actions, I think I would be spending quite a bit of time re-evaluating my life. Definitely would not be partying.

I witnessed a horrible wrong-way accident on the I-95 south in south carolina this summer. Absolutely shook me to the core. So I’ve been thinking about these things quite a bit as of late.

I’m not entirely positive but I thought PI stuff wasn’t admissible in court. I could be wrong. If I had killed three people from my own dumb actions I probably wouldn’t even be able to function, let alone go out and party.
