yeah, kill someone while DWI should >10yrs. But a murder charge is not right.
When will people learn to stop driving drunk.
I admit I have before, but I learned from a mistake and now I won’t drive if I have 2 beers.

I hate drunk drivers.
I won’t even drive if I’ve recently had nyquil or something like that.
Considering I am a skinny guy and shit, and that stuff puts you to sleep a bit…
But seriously, I know better than to fuck someone elses life or my own by doing some stupid like that, and how I can’t imagine living with myself after doing that.

He towed a civic from lewiston for me last summer. He was a nice guy.

When the charge is heavy enough for drinking and driving.
Its a slap on the wrist now, sure it might be a 5,000$ slap on the wrist.
But its still a slap on the wrist.

Dwi should mean you lose your license for the minimum of a year.
then driving without a license (sorry guys) should be a minimum of a year in jail.
Fines arent enough to stop people from doing stuff.

Atleast make it fair.
Say you kill a 16 yr old, on average that 16 yr old probably would have lived to atleast 60.
that 44 years they didnt get to live, so the person who did it, should get atleast 44 years.
Alot less people would drink and drive.
I speak up on this topic, because I lost some friends to it.

I towed for Marty’s towing. I can say that there is a good reason you have to report when your on a call, cause the drivers on the 190 usually are driving like dicks. Its what I would call a very risky job. It was fun, but I would never do it when I had a family, too many fuckers on the road.

not to try and justify the actions of the drunk driver. but he only blew a .09 which a few years ago wouldnt have even been a DWI. i think there is more to this than just a guy too impaired to drive.

Yeah, that’s why I brought up the depraved indifference thing for cases when people are way over the limit. It’s unfortunate MADD has become such a corrupt organization and combined with the insurance industry pushed through .08. The people causing the majority of DWI crashes, the ones where drinking is really to blame, are the ones in the .15 and up range.

It’s like the guy that killed those kids on Transit a couple years ago, not long after they lowered it to .08. He blew a .08 and was facing some serious charges despite the fact that the kids were trying to cross six lanes of traffic, at night, nowhere near a crosswalk or light. Luckily the justice system worked and took into account his .08 was a very minor contributor considering the other horrible choices made that night.

explain that to the family of the tow truck driver, even then the laws werent strong enough to stop alot of people back then. I dont usually side with karter but in this case i have to, even tho I think his jail time is a bit extream. The reason I agree is because I have had 1 DUI and 1DWI both within 18 months. Luckly I did not hurt or kill anyone. As a result my license was revolked but I still drove until I got caught by Nathan in NT. As a result I was sentenced to 90 days in jail, since then I have not gotten behind the wheel at all while drinking. It took me 5yrs to get my license back !!!

My point is that people including myself are stupid sometimes and dont learn their lesson until its to late in some cases.

I am a firm believer in manditory maximums for alot of things, this being one of them. There is to much grey area in regards to the courts and punishment. It should be “you blew this you get this amount of time or x amount of fines”.

Do you know that the law states that you are responsible for the control of your car at all times regardless of the situation??

eh. I’m torn. There are situations where no degree of “control” can avert tragedy.

im not debating that this is a tragic situation for both families involved. all im saying is maybe alcohol didnt play a role at all in this accident. and rather than instantly passing judgement on this guy based on a biased article. it is possible that this is nothing more than just an accident.

Do you know the details of this crash? Was the tow truck in the right lane? Was it clearly visible? Did it have the proper flashers going? Flares out? Was this on a curve?

The fact is we don’t know the details. The crash I did know the details about was the one on Transit which is why I used it as my arguement against stupidly low BAC limits being tied to heavy mandatory sentences.

If you’re going to make .08 murder you better look at all the other things that take away a driver’s ability to be in 100% control of the car. Cell phone conversations (hands free or not), conversations with passengers, reading a nav system, changing CD’s, scanning radio stations, eating, drinking, smoking and keeping an eye on an infant to name a few.

I understand what your saying. But the things you are using to make a comparision are really kind of different. I can multitask with the best of them but throw a .08 on top of that and things change a little.
