Theoretically if he had a gun on him, shooting as they swarmed his car would have been self defense. I would do the same. But to escape the threat, and take on 7 guys with a baseball bat just because they pissed you off… that is ballsy, and certainly not self defense. Replace the bat with a gun at that point, and he’d certainly spend some time in jail.
What were those 7 guys doing anyways? After one too many Yaeger bombs they decided to rip off their Affliction t’s and cause some trouble? WTF
If you’d do the same I’ll warn you that in NY that’s murder. Here you are required to retreat if you can and no prosecutor is going to look at the video with open road in front of your car and say you had no opportunity to retreat. Now if your car was blocked in and you had no means to retreat you could make a case for justification based on the immediate and reasonable fear for your life. You would still almost certainly end up at trial since none of the street idiots had weapons and the prosecution and defense would make their cases about your state of mind and the reasonableness of your stated fear for your life. Seeing as MA is just about as anti-gun as NY I’d be willing to bet their self defense justification requirements are very similar.
True, I guess I was just making the comparison to being swarmed inside your car, and escaping only to return out of spite.
In a situation where 7 guys swarmed my car and I was in fact unable to escape, I would shoot (if I had a gun).

(A) unlawfully and with force entered, or was attempting to enter unlawfully and with force, the actor’s occupied habitation, vehicle, or place of business or employment;
If you are sitting in your car and 7 guys just TRY to force their way in you can blow their faces off. This however will still require you to spend ~$25K+ on a lawyer to represent you in court.
Though if you were to go back and take revenge on them for stepping on your car I’d say you’d be in some heavy shit.

Musician killed outside neighbor’s home
A well-known Dallas musician who beat up his girlfriend and then tried to kick in his neighbor’s door in a drunken rage was killed Sept. 3 after being shot in the head by the neighbor, who thought he was a burglar.
Carter Albrecht, 34, was a guitarist and keyboardist best known for his work with Dallas rock band Sorta, as well as Edie Brickell & New Bohemians.
After hitting his girlfriend several times in the face, Mr. Albrecht followed her as she fled her apartment, but she was able to duck inside again and lock the door, she told police. Mr. Albrecht went to the back of a neighbor’s home, kicking and banging on the door.
The neighbor yelled at him to stop, but he didn’t, so the neighbor shot once at the top of the door. The bullet struck Mr. Albrecht in the head, and he died at the scene. Police declined to file charges against the neighbor.

Yeah, NY refuses to pass a Castle Law, instead saying our current highly limited justification defenses are more than enough.
I believe a vehicle is considered the same as a house in the law (correct me if I’m wrong). If 7 guys are breaking into my house, I’m not hesitating to shoot.
I also agree that if he had driven off, got out, then shot them or in this case beat them…self defense goes out the window. He was moving out of harms way, and was no longer threatened.
Man he was so closed to being stomped to death towards the end too. That guy had some serious cahones to do what he did, however foolish it may have been.

one thing I’ve been wondering is if the guy in the car knew the guys from before this. Something like they all had some heated words “up in the club” and when the dudebro was driving away he just happened to run into the other guys outside.
I highly doubt that. The car prior to “batdude” was being harrased by “dudebro” as well. When “batdude” drove by, “dudebro’s” buddy was making a feeble attemp to hold back his friend and tell “batdude” to “go, go, just go.”
I don’t know much about fighting, but isn’t batman awfully lucky that nobody there knew how to fight? In all the movies I’ve seen if someone takes a long windup to swing like that, they wind up with a slow motion roundhouse to the head which makes them drop the bat and the other guy gets away with the girl.
