Buying an out of state vehicle

for any used car you don’t pay tax out of state, you pay it when you register it here.

Have you actually DONE IT? Because I have. And yes, I paid MI sales tax at the time of purchase for my Expedition. You will NOT buy a car at a DEALER in MI without paying the sales tax, regardless of what state you live in.

I found a GTO in Indiana and looked into it for that state as well. And guess what, you pay the sales tax in Indiana as well. It’s 6 something percent, and you can only claim a credit of 4% when you register in NY.

  • My customer lives in another state. If I charge them Indiana sales tax will they have to pay the sales tax again when they register and/or title their purchase in their home state?

All states are mandated to give credit for a legally imposed sales tax paid to one state against another state’s sales/use tax. This is due to the United States Commerce Clause, which is a federal statute. Thus, if your customer lives in another state, that state should allow the amount of sales tax paid to Indiana as a credit against the amount of sales or use tax due. Your customer may have to pay an additional amount if their home state has a higher tax rate than Indiana or if their state has any local (non-state) imposed taxes. Example: Illinois currently has a state rate of 6.25% plus local taxes. If Indiana sales tax is paid at time of purchase of 6% your customer will only have to pay Illinois the extra .25% state sales tax plus any local taxes due in Illinois. They will get credit for the 6% paid to Indiana, thus no double-taxation. (see warning below)

[indent]Warning - A few states impose a tax different from a sales/use tax, often termed an excise tax. Since the tax is not the same type tax as Indiana’s sales tax these states may not allow a credit for a sales tax paid in Indiana against their tax. It is also possible that a few states have specific tax statutes that do not allow for a credit for a sales tax paid to another state. States known to the Indiana Department of Revenue that may not allow a credit for a sales tax paid to Indiana are Arkansas, Maryland, Mississippi, Oklahoma, and West Virginia. These states may impose additional taxes upon registration and/or titling in their state without allowing a credit for the sales tax paid to Indiana. This list may not be all inclusive. It is provided solely to alert dealers and customers of the existence of these type situations.

I’m actually waiting for an email back from a dealer in PA right now about PA’s version of this mess of a tax law. I’ll post an update with what ever I find out.

I bought two cars in ohio from dealers and was not charged any tax on either of them.

I got it home, and was charged tax based on the bill of sale.

Michigan and other states apples and oranges apparantly.

I bought a car brand new from California. Make sure you pay the state tax in Texas or whatever state you buy the car in if you plan on driving the car in NYS while waiting for the title and registration in NYS.

I had my car impounded in Cheektowaga because I had a temporary California tag with insurance and proof of ownership.

NYS DMV sucks.

Did you buy it from a dealer or private party? Private party is completely different, but he is buying from a dealer.

:word: I bought my car in Georgia. Did not have to pay sales tax until I got here, and drove on temp plates for a long time with insurance from here.

bought my car in ny and paid TX tax… registered it here and insured it here got plates just flying up to drive it home. no ny tax needed to be paid… then again i went thru private seller so your in a different thing then me…
