This is not true…

you are allowed to proceed on your way while waiting for a marked car… or you can wait until you can pull into a public location…

TECHNICALLY The proper procedure is to call 911 and verify with the operator that the car pulling you over is a police car, and request a marked car…

Ie if your on the highway you can keep driving until you can pull into a gas station etc…

This was a reaction to all those rapings a long time ago

I asked my cousin who is a new trooper this very question at X-mas

he said the only way to charge you with evading is if you are flagrant with your “escape”

If you continue along and obey traffic laws, you cant be charged with evading (well you can be charged for anything, but it will be tossed)

^ Your cousin a new trooper, that’s why he said that, because it’s a New York State Police policy. It was signed into law by Pataki as one of his first acts. I dare you to to over to the City of Tonawanda on Two Mile Creek where they use an unmarked car almost exclusively for speed enforcement. Please, I’m serious… try it because it will be entertaining watching you get Rodney King’d on the news.

this question gets asked a million times on every forum. if they have a badge they can basically do what they want and you wont get out of anything. cops word vs yours who do you think is going to win.

Im not saying you wont add significantly MORE hassle to your incident by NOT pulling over…

im just saying they CANT convict you with evading arrest for doing it… thats all…

But the caveat is that you NEED to pull over at the first “public place” available… and not break any more V&T laws

Your Wife is driving on deserted road in boston NY at 3 am in the morning… unmarked car pulls up behind her in the backwoods and flips on lights/siren…

would YOU really want your wife pulling over in the middle of nowhere on the odd chance that its really just a good ol boy with a ex police car and a 30 dollar light kit from pep boys… or would you instruct her to continue driving like a priest until she gets to the nearest public space and pull over there.

That is what the law is designed for…

This happened to a few of my friends.

They were driving down a road in LA (lakkawanna)while drinking beers (yeah, dumbasses) and a off duty cop, driving his personal vehicle pulled up next to them at a light, got out of his car, made them pull over and pulled them all out of the car, searched them etc…
let them go though after he took their beer.

that way you get a ticket for speeding, one for evading, and one for using a cell phone while driving

I got pulled over a few weeks ago by a black SUV with lights in the grill. My wife was driving so she stopped. At least he had on a full trooper uniform.

+1. And I love this phantom “law” he keeps referring to. It doesn’t exist. The only official law on the subject is what I stated that Pataki signed, the one that bars the State Police from using undercover cars for routine traffic stops. The routine part is key too, because I’m sure if an undercover State Police officer sees you doing something real bad like doing a 50-150 pull on the 90 that doesn’t fall under routine traffic stop and he can still pull you over.

Will a judge/DA take into account it was some woman at 3am in the middle of nowhere being pulled over by an undercover and she didn’t immediately stop, sure. But chances are an undercover wouldn’t even be making that stop in the first place for that very reason. The DA however isn’t going to give a shit that Viper was afraid the undercover Tonawanda cop was going to rape him at 6pm on a Sunday in front of the crowd at Mississippi Mudds.
